Financial assistance for Medical Kit provision. 2019 Notice

The Directorate of the Social Marine Institute announces the subsidy scheme, with a maximum amount of 500,000 euros and on a competitive basis, for financial assistance for the mandatory on-board medical kit for ship companies included in the provisions of Royal Decree 258/1999, of 12 February, which sets out the minimum conditions for healthcare protection and medical assistance of seafarers for the year 2023, regulated by the provisions of Order ESS/2542/2014, of 5 December, and in the Resolution of the Social Marine Institute, of 15 April 2024, which includes financial assistance for the provision of medical kits for use on ships, for the year 2023.

In accordance with the amendments made to Article 20.8 of Law 38/2003, of 17 November, the General Subsidies Act, by Law 15/2014, of 16 September, on rationalising the Public Sector and other administrative reform measures, the entire text of the subsidy announcement will be published in the National Subsidies Database.

Type of assistance

Two types of assistance will be provided: for the initial purchase of medical kits and for replacing them. Both include:

  • The pharmacological provision financed by the National Health System in the presentations and quantities required in Annex II of Royal Decree 258/1999, of 12 February, in the wording in force at the time the expenditure is made.
  • The medical material, forming part of the mandatory medical kit, detailed in appendix I of the notice resolution.

These subsidies will not cover amounts corresponding to the purchase or replacement of cabinets and containers in which the on-board medical kit is stored.

Amount

The amount of the assistance will be determined on the basis of:

  1. The regulatory medical kit corresponding to each category of vessel.
  2. The allocation specified for each type of medical kit taking into account the number of  workers registered on the boat.

For both types of assistance schemes, initial allocation and replacement, the amount of the subsidy will be:

  • Medical Kit A: Sixty-five per cent (65%) of the actual cost of the medicines included in the regulatory medical kit funded by the Social Security and the actual cost of the medical materials included in appendix I of this notice resolution.
  • Medical Kit B: Seventy per cent (70%) of the actual cost of the medicines included in the regulatory medical kit funded by the Social Security system and the actual cost of the medical materials included in appendix I of this notice resolution.
  • Medical Kit C: Ninety per cent (90%) of the actual cost of the medicines included in the regulatory medical kit funded by the Social Security system and the actual cost of the medical materials included in Appendix I of this notice resolution.
  • Life raft medical kit: Ninety per cent (90%) of the actual cost of the medical kit.
  • Dangerous goods medical kit: 65% of the actual cost of the medical equipment included in Annex I.

The assistance will cover all medical kits on board, which the vessel is required to carry, requested by the beneficiary.

Beneficiaries

The subsidies may be applied for by employers who operate vessels duly registered or flagged in Spain for maritime shipping or fishing, excluding:

  • River navigation.
  • Warships.
  • Recreational craft used for non-commercial purposes that do not have a professional crew, and
  • Tugs sailing in the port area.

An employer is understood as the registered shipowner or shipping or fishing company that owns a ship, except if the ship has been chartered with the assignment of nautical management or is managed, in whole or in part, by a natural or legal person other than the registered owner, in accordance with the terms of a management agreement; in this case, the charterer with nautical management or the natural or legal person managing the ship will be considered an employer.

Applications

Applications, as well as other documents and communications, will be submitted according to the provisions of articles 14 and 16 of Law 39/2015, of 1 October, on the Common Administrative Procedure of Public Administrations.

Filing in a physical manner, by applicants who are not obliged to relate electronically with the administration in accordance with the provisions of Article 14 of Law 39/2015, of 1 October, shall be made on the form attached as Annex II, and shall be signed by the interested party or by those who accredit their representation by any means valid in law, at the provincial or local offices of the Social Marine Institute where the ship, for whose medicine chest the assistance is requested, has the contribution account code assigned to it.

Filing through the electronic register will be carried out through the corresponding service in the Social Security Electronic Headquarters. This service allows you to submit your application and sign it, attaching the corresponding documentation.

If the application is submitted by an electronic means other than the above, it must be accompanied by the form attached as Annex II, duly signed electronically.

When the subsidy applicant is a joint ownership or a professional civil society, they must include the relevant appendix indicating the details and signature of all its members. The application shall be submitted and signed by the legal representative of the company or community.

Applications must be accompanied by the following documentation:

  • Accreditation of the identity of the applicant and/or legal representative.
    In the case of applicants who are natural persons and their legal representatives, unless the Social Marine Institute is authorised to consult the identity data of the Ministry for Home Affairs, they must present their national identity card or foreigner's identification document.
  • In the event that the applicant is an entity, with or without legal personality, unless the Social Marine Institute is authorised to consult its identity data with the Tax Agency, it must provide the document accrediting the beneficiary's tax identification number.
  • Representation shall be accredited by any means, valid in law, that provides reliable proof of its existence, in accordance with article 5.4 of Law 39/2015, of 1 October, in addition, it may be accredited by the certification issued by the provincial directorate of the corresponding Social Marine Institute, as shown in annex III of the call for applications.
  • Original invoice itemising the expenditure incurred when purchasing the medicines financed by the National Health System that forms part of the mandatory medical kit and/or an invoice detailing the expenditure incurred when purchasing the medical material included in the mandatory medical kit and provided for in appendix I of the resolution, in which each of the products invoiced is listed.

    The expense will be accredited with invoices and other equivalent documents valid in legal commercial trade or with administrative effects.

    The total cost of the medical kit must feature in the invoice for the life raft.

    If a single invoice includes items for the acquisition or replacement of medicines or medical material for different vessels belonging to the same beneficiary, the invoice must specify which items correspond to each vessel. In the absence of such a record, all items shall be applied to a single ship for the purpose of setting the limit determined by the statutory first-aid kit strength.

When financial aid is requested for expenses incurred for medicines and/or medical supplies that correspond to different types of first-aid kits, separate invoices must be submitted, each one including the items that correspond to each type of first-aid kit. If articles belonging to different types of first-aid kits are included in the same invoice, all of them shall be applied to the main first-aid kit, for the purpose of setting the limit determined by the regulatory provision of the first-aid kit.

In the case of applications submitted through the electronic register, paper invoices shall be digitised by the applicant in separate files containing a true and complete image of the document. The original must be kept by the interested party, who may be required to produce the original document for comparison at any time.

  • Certificate of revision of the life rafts issued by a service station approved by the Directorate General of the Merchant Navy of the Ministry of Transport, Mobility and the Urban Agenda, corresponding to the year 2023, when aid is requested for the initial provisioning or replacement of the regulatory first-aid kits for these rafts. The full replacement of the life raft's medical kit must explicitly feature in this certificate or its appendices.
  • Bank certificate stating the beneficiary account holder of the account to which the payment of the subsidy is requested, following the model indicated in  appendix IV of the notice.
  • Unless authorised by the Social Marine Institute to obtain information from the State Tax Administration Agency and the Social Security General Treasury on the fulfilment of tax and Social Security obligations, the interested party must present the certificates certifying that they are up to date with the payment of these obligations.

When the applicant is a joint ownership or professional civil society, this information will also be collected on each of its members, unless there is no authorisation, in which case they must also submit the relevant certificates for each of the members.

  • For vessels registered in 2023, a Medical Kit Inspection Certificate for 2023 issued by the Subdirectorate-General for Foreign Health of the Ministry of Health when applying for a subsidy for the initial medical kit.

Publicity

In the year following the awarding of the subsidy, in order to give adequate publicity to the public nature of the scheme, the beneficiaries must place a sticker in a visible place on the main kit of the subsidized vessel as per the model defined in Annex VIII of the notice resolution.

For this purpose, the provincial offices of the Social Marine Institute will provide the subsidy beneficiaries with the corresponding stickers within the month following the date of the resolution.

Presentation period

This notice sets out a single selection and decision procedure. The submission deadline for applications will be one month as of the entry into force of the notice resolution.

The deadline for submitting applications is one month from the day following publication in the Official State Gazette of the extract from the call for applications.

The period for submission of applications starts on 22 April 2024 and will end on 21 May 2024 inclusive.

Purpose

  • The financial assistance is intended to subsidise the initial provision of medicine cabinets, meaning the initial purchase of drugs and medical supplies that make up the on-board medicine cabinet, in accordance with the provisions of Annex II of Royal Decree 258/1999 of 12 February 1999, in the wording in force at the time the expenditure is incurred, when it is the first time that the employer applies for the assistance corresponding to the Social Marine Institute and the expenditure incurred for this item has been incurred between 1 January 2023 and 31 December 2023, both inclusive.

  • Likewise, assistance is also available for the replacement of medicine cabinets, aimed at subsidising the replacement of the drugs and health material that must make up the mandatory medicine cabinet, in accordance with the provisions of Annex II  of Royal Decree 258/1999, of 12 February, in the wording in force at the time the expenditure is made, with replacement being understood as the purchase of medicines and/or health material that have expired, deteriorated or been consumed, provided that the expenditure made for this item has been incurred between 1 January 2023 and 31 December 2023, both inclusive.
