Validation of private centres to provide specific health training.

Under articles 5 and 7 of Order PRE/646/2004, of 5 March, which establishes the minimum content for specialist health training programmes and the conditions for teaching and approving health training certificates for seafarers, it is the responsibility of the Social Marine Institute to approve and control the conditions that must be met by private centres that wish to provide specialist health training.

Resolution of 24 April 2013 by the Social Marine Institute, on the conditions that must be met by training centres and the approval procedures for private centres that wish to provide specialist health training, regulates the approval procedures for private centres for providing specialist health training.

General conditions of the centres.

Centres authorised to teach specialist health training courses will be subject to compliance with the provisions of Agreement STCW-78/95 and, in particular, the following:

  1. Implementation of a quality system (established under Rule I/8 and Section A-I/8).
  2. Guarantee that those responsible for training and assessment are duly qualified in the material taught and that the training of students is administered, supervised and controlled pursuant to the provisions of Rule I/6 and Section A-I/6.
  3. Guarantee that the theory-practical content is taught and the time frames established for each beginners' and advanced specialist health training course and refresher courses are respected.
  4. Guarantee the minimum safety and comfort conditions at the sites where courses are provided; equipment, teaching materials and facilities for each level of beginners' and advanced specialist health training established in the annex to Order PRE/646/2004, of 5 March, which establishes the minimum content for specialist health training programmes and the conditions for teaching and approving health training certificates for seafarers.

Types of approval.

Private centres may request approval to teach specific health training courses and refresher courses in the following ways:

a) Regular form: Classroom(s) at which courses are provided are authorised as soon as approval is granted. This form is divided into two categories:

  1. Fixed facilities: facilities at which training is provided at the site authorised as part of the corresponding approval.
  2. Mobile units: mobile structures (articulated lorries or any other system) that are fully equipped with the material and equipment required to teach specialist health training courses.

b) Field form: The classroom(s) at which each course is provided are authorised prior to the start date.

Request.

The approval request must be made by completing Annex II (official request form) and sending it to the Directorate of the Social Marine Institute; this document must be submitted along with the additional documentation indicated below to the central services of the Social Marine Institute, at its provincial headquarters or local centres, or sending it by any means permitted under article 38.4 of Law 30/1992, of 26 November, of the Legal Regime of Public Administrations and the Common Administrative Procedure.

One request must be submitted for each modality or training subtype that the centre wishes to teach; requests must be accompanied by the following documentation:

a) Accreditation of the identity of the applicant and/or legal representative. For the purposes of identification, the applicant must present:

  1. For individuals: the approval form (Annex III) duly filled in for the purposes of corroborating data using the IT system, with the corresponding confidentiality guarantees. Failing this, an attested photocopy of his/her national identity document, passport or NIE (foreigner's identification number).
  2. For legal entities: certified photocopy of the beneficiary's tax identification number.
  3. Supporting documentation for the legal representative, where applicable. This may be replaced by certification issued by the corresponding provincial headquarters of the Social Marine Institute.

b) Articles of association, for legal entities.

c) Certificate demonstrating that the requester has no outstanding tax and Social Security payments. No such certificates will need to be presented by the requester if he/she consents to said documents being collected by the management body of the State Treasury Administration Department and the Social Security Treasury General.

d) Certificate of the quality system implemented, issued by an external auditor, which includes the provision of specialist health training.

e) Report describing the points specified in Annex VI of the Resolution of 24 April 2013:

  1. Facilities, furniture and equipment (only for regular courses):
    1. Minimum classroom surface area (m2/student).
    2. Description of shared facilities.
    3. Description of teaching fittings and auxiliary elements.
    4. Safety and hygiene equipment on site: fire-extinguishing devices, safety signage, first-aid equipment, habitability of classrooms (heating, air conditioning, lighting, cleaning, etc.).
  2. Teaching methods and material:
    1. Description of audiovisual material used in training activities.
    2. Description of teaching aids.
  3. General organisation of the centre.
    1. Maintenance and conservation plan for equipment and materials.
    2. Training plan (course content and times frames assigned, design of theory and practical teaching units, procedure to be used in theory and practical tests during courses).
    3. Assessment methods for the training activities.
    4. Form for reporting on teaching activities. 
    5. Survey form for assessing student satisfaction.
  4. Human resources.
    1. Teaching staff. 
    2. Administrative staff.
  5. Administrative management. Tasks related to administrative control and tracking for the courses provided: filing of academic transcripts and documentation for students, backup copies of computer files, sample master record for certificates and awards granted, sample master records for courses.

f) Declaration of adherence to the minimum conditions set out under annex II of Order PRE/646/2004, of 5 March.

g) A copy of the student handbook, the content of which must be adjusted to the objectives set out under annex I of Order PRE/646/2004, of 5 March.

All documentation will be provided in paper copy and in electronic form.

Validity of the approval.

Once a successful resolution is handed down by the Directorate of the Social Marine Institute, the approval will remain valid for a maximum of three years, effective from the date on which the notification was issued.

Approvals regarding beginners' and/or advanced specialist health training will also apply to the corresponding refresher courses.

The approval of centres to provide advanced specialist health training and refresher courses will also represent approval to teach beginners' specific health training and refresher courses under the authorised modality.

Both the approval resolution and those applicable to successive renewals will be published in the "Official State Gazette".

Renewal of approval.

The effectiveness of approvals may be renewed for successive three-year periods provided that a request is made at least one month prior to the end date.

One request (Annex II) must be made for each modality and type of training requested, accompanied by the following documentation:

  1. Report on the courses carried out based on the approval for which renewal is requested.
  2. Certificate demonstrating that the requester has no outstanding tax and Social Security payments. No such certificates will need to be presented by the requester if he/she consents to these documents being collected by the management body of the State Treasury Administration Department and the Social Security Treasury General (Annex V).
  3. Certificate of the quality system implemented, issued by an external auditor, which includes the provision of specialist health training. 
  4. Declaration (Annex VII) of adherence to the minimum conditions set out under annex II of Order PRE/646/2004, of 5 March.
  5. For trainers who wish to remain part of the teaching staff assigned to the centre, a request pursuant to the established model (Annex VIII).

The Subdirectorate General of Maritime Social Action will raise the approval renewal request with the Directorate of the Social Marine Institute based on the report, curricula, practical tasks and other documentation submitted by the centre as regards the courses offered as a result of the approval; it will do so having examined the documentation and once the provincial headquarters of the corresponding Social Marine Institute has checked that the minimum material and teaching conditions are being met pursuant to Order PRE/646/2004, of 5 March.

Courses taught on a regular basis.

The approved centres must send following information on the regular courses to the provincial headquarters of the Social Marine Institute, whose territory includes the centre where the courses will be taught:

At least two weeks before the course begins:

  1. The location at which the course will be taught.
  2. Start and end dates.
  3. Distribution of course content across the days on which it is taught.
  4. Teachers assigned to teach the course.

Once the course ends:

  1. Within seventy-two hours of the course having ended, email the details of students that have passed the course.
  2. Within seven days of the course ending, the corresponding records must be provided.

Courses taught in the field.

Once approval has been granted, the Directorate of the Social Marine Institute, through the Subdirectorate General of Maritime Social Action, will nominate the provincial headquarters that will serve as a hub for the other provincial headquarters at which courses are taught. The hub provincial headquarters will gather inspection reports and documentation from other provincial headquarters regarding the classes and courses which will provide training in the field.

The approved centre must provide the hub provincial headquarters with the following information regarding the courses taught regularly:

At least one month before the course begins:

  1. Annex IX of the Resolution dated 24 April 2013, which must feature the location, characteristics of the classroom where the course will be taught, the start and end dates and the distribution of the course dates, and a list of teachers.
  2. A floorplan or sketch that indicates the dimensions of the classroom(s) where the course will be taught.

Once the request has been received, the hub provincial headquarters will request all inspection reports and documentation from the provincial headquarters at which training will be provided, regarding the classrooms where the courses will be taught, in order to issue the corresponding authorisation to hold the course.

Once the course ends:

  1. Within seventy-two hours of the course having ended, email the details of students that have passed the course.
  2. Within seven days of the course ending, the corresponding records must be provided.

Certifications.

The private centres approved by the Social Marine Institute shall give the students who have completed the specific health training courses a certificate in accordance with Appendix I to the Resolution of 24 April 2013, which may be submitted to any provincial office of the Social Marine Institute for the purposes of issuing the relevant Specific Health Training Certificate of appendix IV to Order PRE/646/2004, of 5 March, duly updated.

Human resources.

Every course must have:

  1. A course coordinator, who will be the person responsible for supervising and controlling the course and for resolving any issues that may arise.
  2. The teachers assigned to deliver the course's theoretical and practical teaching modules must include at least one graduate of medicine and one holder of a degree or university diploma in nursing or an equivalent qualification.

The centres must provide the documentation listed below for each one of the teachers in order to have them accredited by the Social Marine Institute:

  1. Application in line with the template provided in Appendix VIII to the Resolution of 24 April 2013.
  2. In order to provide proof of identity, the teacher may either submit a certified photocopy of their national identity document or foreigner identification number, or authorise the Social Marine Institute to collect their identification details from the Ministry of the Interior, checking the relevant box on the application for this purpose.
  3. Certified photocopy of the relevant academic qualification.
  4. Proof of qualified teacher status by means of a certified photocopy of one of the following documents:
    • • Diploma certifying completion of a training course of at least 60 hours for trainers in health training for seafarers, issued by the Social Marine Institute.
    • • Diploma certifying completion of a teaching techniques course of at least 80 hours, issued by a body other than the applicant.
    • • Documentation certifying the provision of at least 160 hours of teaching activity associated with the subject matter to be taught.

The validated centre must notify the Social Marine Institute of any changes to its teaching workforce. If the change relates to hiring a new teacher, it must be accompanied by the documentation mentioned above.
