Updates on civil service pensions

Who does it affect? Recipients of civil service pensions due to retirement or compulsory retirement, disability, and widows’ pensions between 1 January 2016 and 3 February 2021, with two or more children, provided that the mother was not already recognised as having the same entitlement.

How much is it? A percentage of the amount of the pension awarded, based on the number of children.

The financial effects will apply from the date of the event giving rise to the pension, with a maximum retroactive period of four years. (Regulation: Law 47/2003: 26.11. Article 25).

How do I apply? Those wishing to apply must submit the relevant written application, stating the mother’s surname, first name and DNI, and attaching a copy of the Family Register or full birth certificates for the children.

This allowance replaces the previous Maternity Allowance.

• Who is affected? Pensioners (men or women) receiving a civil service pension due to retirement or compulsory retirement, disability, or as a widow’s pension from 4 February 2021 onwards, with one or more children, provided that the other parent has not already been granted the same entitlement

• How much is it? For 2023, the amount payable will be €30.40 per month per child, up to a maximum of four children.

• How do I apply? Those wishing to apply must submit the relevant written application, stating the surname, first name and DNI of the other parent, and attaching a copy of the Family Book or full birth certificates for the children.

This allowance replaces the previous Maternity Allowance.

Who does it affect? To pensioners in the Civil Service Pension Scheme who have retired or been compulsorily retired, with effect from 1 January 2022, for each full year by which they extend their period of active service.

How much is it? You must choose one of the following options:

1. A monthly rate of 4% of your pension for each full year of deferral, or
2. A lump sum, based on full years of contributions, or
3. A combination of both. (This option has not yet been set out in regulations and is therefore not currently available).

How do I apply? Those wishing to do so must indicate their chosen option on their retirement application submitted to the relevant retirement body of the ministry or organisation where they were employed.

Should you fail to indicate your choice at that time, this Directorate-General will write to you asking you to exercise the aforementioned right of choice as soon as it receives the documentation from your ministry or agency recognising your retirement pension.

Lifting of the ban on granting new orphan’s pensions to orphans over the age of twenty-one who are not disabled, in accordance with current legislation in force on 31 December 1984 or under special wartime legislation. (In force since 21 October 2022).

Where is it regulated? In the sole repealing provision, paragraph 2 of Law 20/2022 of 19 October on Democratic Memory, which came into force on 21 October 2022. ORPHANS’ PENSIONS.

Who does it affect? To those interested who meet the eligibility criteria for orphans’ pensions under the former Civil Service Pensions legislation and for war pensions, in particular those provided for in Article 59 of the TRLCPE.

How do I apply? Introducing the official forms:

• Electronically. If you have an eDNI or an electronic certificate, via the Civil Service Pensions Management eOffice.

• By post. In writing or by downloading the official form from the ”Applications and Procedures” section and selecting the form entitled “Application for a family pension for civil servants who retired or died before 1/1/1985” (pdf) Application for a family pension arising from the Civil War (pdf). • In person. If you would prefer to submit your application in person at our offices, you will need to make an appointment in advance under the “Services Other procedures” section, where you can select the date and time of available appointments from the calendar. This procedure is essential if you are to be seen at the offices.
