Management / Applications

The management and recognition of the right correspond to the National Social Security Office (INSS) or to the Social Marine Institute  (ISM), if dealing with workers included under the scope of the Special Scheme of Sea Workers.

The documents listed below must be presented, except for identity documents where the original will suffice.

IN ALL CASES:
  • Proof of identity of the applicant and legal representative by means of the following valid documentation:
    • Spanish Citizens: National Identification Document (DNI). 
    • Foreign citizens, whether resident or non-resident in Spain: passport or, where appropriate, identity document in force in their country and NIE  (Foreigner Identity Number) required by the AEAT for payments.
  • Supporting documentation for the legal representative, where applicable. If they are an institutional guardian, the CIF/NIF, a document stating the Institution's appointment as guardian and certificate proving the Institution's legal representation. Proxies registered in the electronic register of proxies do not need to accompany a supporting document.
IN SPECIAL RETIREMENT AT 64 YEARS OF AGE:
  • Company certificate on the details of the substitute worker.
IN PARTIAL RETIREMENT:
  • Company certificate on the employment data of the partial retiree and the relief worker.
  • Certificate accrediting a degree of disability equal to or greater than 33% (for access to partial retirement with a minimum contribution period of 25 years).

IN ACTIVE RETIREMENT:

  • In the case of employed persons, the company’s agreement to take up active retirement.

PRIMARY CARE PRACTITIONERS:

  • In the case of compatibility of the pension with work as a primary care practitioner assigned to the National Health System, agreement from the company or organisation for the compatibility of retirement with work as a primary care practitioner and certificate from the Public Health Service accrediting the performance of work as a primary care practitioner assigned to the National Health System.
IN EARLY RETIREMENT:
  • With age bonus for the activity:
    • If you have worked in an activity with a recognised age bonus: certificate from the company(ies) stating the occupational classification and the periods of employment in that position, or the embarkment and disembarkment card for the ISM.
  • Disability >65% or illness listed in RD 1851/2009
    • Medical report stating that the worker is affected by any of the disability-generating pathologies referred to in Royal Decree 1851/2009 and the date on which the pathology began or manifested itself.
    • Certificate of disability and recognised degree issued by IMSERSO  or competent body or Judicial Decree, indicating, if applicable, that it is a consequence of one of the illnesses listed in RD 1851/2009, as well as the date of onset of the disability and the date of qualification.
    • Accreditation of the need for assistance from third parties or reduced mobility, issued by IMSERSO or the competent body, where applicable. 
  • Involuntary:
    • Documentation proving that the type of termination was involuntary.
    • In the event of termination due to collective dismissal for economic, technical, organisational or production reasons, due to objective dismissal or due to the employee's will for the reasons set out in Articles 40.1, 41.3 and 50 of the Workers' Statute, accreditation of having received the corresponding compensation derived from the termination of the employment contract. If you have not received compensation, proof that you have lodged a lawsuit.

TO PROVE OTHER CIRCUMSTANCES:

  • Other circumstances:
    • Certificate of compulsory military service or substitute social service or social service for women, or military service record.
    • If you have had a birth, miscarriage, adoption or foster care that has been alleged in the application, certificate from the Civil Registry, family book, adoption resolution or administrative or judicial foster care decision.

FOR THE PURPOSE OF SUPPLEMENTS FOR PENSIONS BELOW THE MINIMUM PENSION:

  • In the case of foreigners resident in Spain: certificate of registration in the Central Register of Foreigners or Foreigners' Identity Card.
  • Family book, civil registry records or official certificate accrediting the relationship of the spouse with the applicant, if applicable.
