Benefits included in the Agreement

General information

The Agreement applies to the following benefits:

Relating to Spain:

To the following benefits in the Social Security System:

  • Benefits for permanent disability that was not originated by a work-related injury or occupational disease.
  • Benefits for old age.
  • Benefits for death and survival that were not originated by a work-related injury or occupational disease.
  • Family benefits.
In relation to Canada:

It applies to the benefits included in the legislation on Canadian Old Age Security and Pension Plan.

Regarding these benefits, remember that:
  • To get the contributory benefits included in the Agreement, periods of insurance fulfilled in Spain and Canada can be added together.
  • Economic benefits, with the exception of Spanish non-contributory benefits, can be collected regardless of whether the interested party is resident or currently located in Spain or Canada.
  • Each country will pay its own benefits directly to the beneficiary.
  • Those who meet the requirements of the legislations of both countries for entitlement to a contributory pension may receive it from either country.

Spanish Social Security Benefits

The competent Spanish Institution will examine the application for a benefit taking into account only periods of insurance in Spain and will grant it, if the person is entitled to the pension without needing to add in periods of insurance or residence in Canada.

If the interested party is not entitled under the terms of the previous paragraph, the institution will add in the periods of accredited insurance or residence in Canada. In this case, the benefit will not be for the whole amount but a proportion of the periods of insurance in Spain and the sum of the periods in both countries.

In the case of a Spanish Social Security retirement pension that considers a total of insurance periods accredited in Canada, this total shall also be used to determine the age of entitlement to the pension.

Canadian Social Security Benefits

The competent institution will examine the application for a benefit taking into account only periods of insurance in Canada and, if the person is entitled to the pension without needing to add in periods of insurance or residence in Spain, will grant it.

  • Old Age Security Law

If, under the terms of the previous paragraph, the applicant is not entitled to the benefit through periods of residence in Canada any periods of insurance in Spain will be added in. Similarly, if the interested party is not entitled to collect a pension outside Canada, according to Canadian periods of residence, the periods of residence in Spain will be added in.

In these cases, the amount of the pension that is payable will be calculated on the periods of residence in Canada.

  • Canadian Pension Plan

If the interested party is not entitled to a pension for contribution periods under this Plan, the competent Canadian institution will add the periods contributed for in Spain. The amount of the benefit will be calculated by multiplying the amount permitted under Canadian law by the result of dividing the actual periods of contribution to the Canadian Pension Scheme by the minimum period required to be entitled to the benefit.
