Recognition of civil service pensions and benefits

As a general rule, civil servants will be classified under, and will make contributions towards, one of the following schemes in order to accrue entitlement to their future retirement pension and to provide for their dependants:

Exception: staff covered by the Civil Service Pension Scheme as at 31 December 2010 who, after that date and without any interruption, join, regardless of the route of entry, or rejoin another corps which, on that date, had resulted in their inclusion in the Civil Service Pension Scheme, shall continue to be covered by that scheme.

In the event of incorrect classification, it is the bodies responsible for personnel matters at the organisation to which the civil servant is assigned that are responsible for verifying and ensuring their correct classification.

For the purposes of incorporating years of contributions under the Civil Service Pension Scheme into Social Security pensions, pursuant to the reciprocal calculation of contributions between Social Security schemes, the person concerned must request a certificate of service to the State, which shall be issued on the official Form CS by the personnel department of the ministerial department or Autonomous Community where the civil servant was last posted.

• Regulation: Royal Decree 691/1991 of 12 April. It should be noted that the period of contributions made under any other social security scheme does not appear on the Certificate of Service, but rather on the Employment History Report.

It should be noted that the period of contributions under the Civil Service Pension Scheme is not included in this report, but is set out in the certificate of service to the State.

Who do I apply to for retirement?

You should contact the Personnel Department of the Ministry or Autonomous Community to which you are assigned and request the relevant retirement or early retirement form.

Who decides on retirement?

The personnel department of your Ministry or Autonomous Community is responsible for deciding on retirement or early retirement.

How is my pension recognised?

The retirement department of your Ministry or Autonomous Community will forward all the documentation required to grant your retirement or early retirement pension to this Sub-Directorate-General for Civil Service Pension Management.

When will Civil Service Pension Management get in touch with me?

The Sub-Directorate-General for Civil Service Pension Management will send you:

1. By post: a letter titled “Notice of Commencement of Proceedings”. This is an information letter to inform you of the date on which your pension application was received and the timeframes for a decision to be made.
2. Notification by text message or email: once your pension has been decided, you will be sent a message informing you that a decision notice is available, which you can access online via the Civil Service Pension Management e-Office, under the section “My notifications/my communications”, provided you have previously registered for this service using your eDNI or your electronic certificate.
3. By registered post: if you have not signed up for the electronic notification service, you will receive the decision on your Civil Service pension and the first payslip of the month at your home address a few days later. In addition, every year you will receive the following at your home address at the end of:

• • January: the letter regarding the annual pension increase.
  • February: the Certificate of Income Tax Withholdings, for filing your tax return.

Civil service pensions fall within the scope of the EU Regulations on the coordination of social security systems between Member States. (These are the Member States of the European Union, the European Economic Area, Switzerland, the United Kingdom of Great Britain and Northern Ireland, and, under bilateral agreements, Japan and Senegal.)

Applications for a pension under the EU Regulations must be submitted to the competent authority in the applicant’s country of residence; in Spain, this is the Sub-Directorate-General for the Administration of Civil Service Pensions.

In general, anyone who is or has been:

• A lawful spouse
• Their cohabiting partner
• Former spouses (in cases of legal separation, annulment or divorce) for whom entitlement to a widow’s pension is conditional upon their entitlement, under a settlement agreement and a court order or judgement, to a compensatory allowance, subject to certain exceptions.

The amount of the widow’s pension will be 50% or 25% (in the case of special pensions) of the deceased’s Base Rate.

And from 01.01.2019, the applicable percentage will be 58% or 29% (in the case of special pensions) of the deceased’s Base Rate , provided they meet the established requirements.

Only where a compensatory pension or compensation has been recognised by a court order or judgement and by a settlement agreement, and which ceases upon the death of the former spouse.

Exceptions:

• Being a victim of sex-based violence at the time of legal separation or divorce, or
• Being over 50 years of age on the date of the deceased’s death, or having children in common from the marriage, provided that the following three requirements are also met:
  • The legal separation or divorce must have taken place before 01.01.2008.
  • No more than 10 years must have elapsed between the date of the legal separation or divorce and the death of the deceased. (Until 01.01.2018).
  • The marriage must have lasted for at least 10 years.

The children of the deceased civil servant who are under 21 years of age, as well as those who were totally incapacitated for work before reaching that age or before the date of death.

Children under the age of 21 may defer payment of the orphans’ pension until:

• Those aged 25, if they are not employed in the private sector or are not in work, will earn less than the current minimum wage on an annual basis. (Ex officio).
• A second extension on the grounds of study, provided that, upon reaching the age of 25, the person is still pursuing academic studies. (At the request of a party).

In this case, the extension would run until the first day of the month following the start of the next academic year (generally until the following October).

The amount of the orphans’ pension shall be 25% or 12.5% (in the case of special pensions) of the deceased’s Base Rate, to be divided equally amongst all the children.

Yes, provided that they were financially dependent on the person whose pension it was at the time of their death and there are no other beneficiaries entitled to that pension (lawful spouse, civil partner, former spouse or children).

The amount of the parents’ pension shall be 15% or 7.5% (in the case of special pensions) of the deceased’s Base Rate, payable to each parent, with no possibility of accumulation in the event of the death or loss of legal capacity of either parent.
