Ayudas provisionales
The Law provides for the granting of provisional assistance, taking into account the vulnerable situation of the victim of the offence, regardless of the fact that, as a general rule, such assistance is conditional upon a final court ruling having been issued to bring the criminal proceedings to a close
Aid may be granted on a provisional basis – before a final court ruling is handed down bringing the criminal proceedings to an end – provided that the victim or their beneficiaries can demonstrate that they are in a precarious financial situation. Such financial vulnerability is deemed to exist when their annual income does not exceed the IPREM in force on the date of the application.
In cases where the victim of a crime is classified as a victim of sexual violence or sex-based violence, in accordance with the provisions of Article 2.1 of this Act, provisional aid may be granted regardless of the financial circumstances of the victim or their dependants.
The amount of provisional aid may not exceed 80 per cent of the maximum amount of the corresponding final assistance, except in the case of assistance for funeral expenses and mental health damage resulting from sexual or sex-based violence, where this limit shall not apply.
