Articles 5 and 7 of Order PJC/1424/2025 of 9 December establishing the minimum contents of specific health training programmes and the conditions for the issuing and approval of the health training certificate for seafarers, stipulate that the Social Marine Institute is responsible for the approval and control of the conditions to be met by private centres that intend to provide specific health training.
The Resolution of 15 December 2025, of the Social Marine Institute, on the conditions to be met by training centres and the procedure for the approval of private centres for the provision of specific health training, regulates the procedure for the approval of private centres to provide specific health training courses.
General conditions of the centres.
The centres that are to provide the health training courses shall meet the conditions laid down in the provisions of the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers, 1978 (STCW Convention) and the Seafarers' Training, Certification and Watchkeeping Code, and in particular the following:
a) implement a quality standards system in accordance with Regulation I/8 and related Section A-I/8 and relevant national regulations.
b) Ensure that those responsible for training and assessment are appropriately qualified in the subjects they teach and that training of students is administered, supervised and controlled in accordance with the provisions of Regulation I/6 and Section A-I/6.
c) Guarantee the development of the theoretical-practical contents and the timetable established for each specific initial and advanced health training course and its updates.
d) Guarantee the minimum conditions of safety and habitability of the teaching premises, the equipment, teaching material and consumables for each level of specific health training, initial and advanced, established in Annex II of Order PJC/1424/2025 of 9 December, establishing the minimum contents of the specific health training programmes and the conditions for the issuing and approval of the health training certificate for seafarers.
Types of approval.
Private centres may apply for approval to provide the specific health training courses and their updates in:
a) Stable modality: The classroom or classrooms where the courses are given are authorised at the time of approval. This modality is subdivided into two types:
1. Fixed installations: those in which the training takes place in the premises authorised in the corresponding approval.
2. Mobile units: those located in mobile structures (articulated lorries or any other system) fully equipped with the necessary material and equipment to deliver specific health training courses.
b) Itinerant modality: The classroom or classrooms where each course is given are authorised prior to the course being given.
Application.
The application for approval shall be formalised by completing Annex II (official application form) and shall be addressed to the Directorate of the Social Marine Institute, submitting the same and the complementary documentation indicated below, in accordance with the provisions of Articles 14 and 16 of Law 39/2015 of 1 October on the Common Administrative Procedure of Public Administrations.
A separate application must be submitted for each of the modalities or sub-types of training to be provided, accompanied by the following documents:
a) Without prejudice to the provisions of Article 9 of Law 39/2015 of 1 October on documentation accrediting the identity of the applicant and/or legal representative:
1. In the case of applicants who are natural persons and their legal representatives, unless the Social Marine Institute is authorised to consult the identity data of the Ministry for Home Affairs, they must present their national identity card or foreigner's identification document
2. In the event that the applicant is an entity, with or without legal personality, unless the Social Marine Institute is authorised to consult its identity data with the Tax Agency, it must provide the document accrediting the beneficiary's tax identification number.
Likewise, documentation accrediting representation must be submitted by any valid means in law that provides reliable proof of its existence, in accordance with Article 5.4 of Law 39/2015 of 1 October.
b) Certification accrediting that they are up to date with their tax and Social Security obligations, unless they authorise the Social Marine Institute to obtain the corresponding information from the State Tax Administration Agency, the Regional Tax Authorities and the Social Security General Treasury.
c) Certificate of the quality system in place, issued by an external audit, stating that the provision of specific health training is included. If this certificate is not available at the time of application, it must be submitted within six months of the date of the provisional decision provided for in resolution eight.
d) Descriptive report on the organisation of the centre and the means at its disposal as established in Annex III of the Resolution of 15 December:
1.- Facilities, furniture and equipment (only for stable modality).
a. Minimum classroom area (m2/pupil).
b. Description of common facilities.
c. Description of furniture and ancillary items.
d. Health and safety measures in the premises: fire extinguishing devices, safety signs, first aid kit, habitability conditions of classrooms (heating, air conditioning, lighting, cleanliness, etc.).
2.- Didactic means and materials.
a. Description of the audiovisual media used for the training activity.
b. Description of teaching support material.
3.- General organisation of the centre.
a. Maintenance and upkeep plan for equipment and materials.
b. Training plan (course content and time allocated, design of theoretical and practical teaching units, procedure for conducting theoretical and practical course tests).
c. Methods of assessing training activities.
d. Model report on teaching activities.
e. Student satisfaction survey model.
e) Declaration of compliance with the minimum conditions set out in Annex II of Order PJC/1424/2025 of 9 December, by ticking the corresponding box on the application form.
f) A copy of the student handbook, the content of which conforms to the objectives set out in Annex I of Order PJC/1424/2025 of 9 December, corresponding to each of the levels of training for which approval is sought.
All documentation will be provided in an electronic format. The original paper documentation shall be digitised by the applicant in a separate file for each document, containing a true and complete image of the document. The original must be kept by the interested party, who may be required to produce the original document for comparison at any time.
Validity of the approval.
Once the favourable decision has been issued by the Director of the Social Marine Institute, the approval will be valid for a maximum period of five years from the date of its notification.
The approval of the centres for the provision of advanced specific health training and its updating shall also include approval for the provision of initial specific health training and updating in the same authorised modality.
The approval of centres for the provision of initial specific health training and its updating shall also include approval for the provision of basic initial specific health training in the same authorised modality.
Existing approvals relating to specific initial and/or advanced health training shall be extended to their corresponding refresher programmes.
Both the approval resolution and those corresponding to the successive extensions shall be published in the Official State Gazette.
Extension of approval.
The validity of approvals may be extended for five-year periods provided that an application is made at least one month before the expiry date.
A separate application must be submitted for each of the modalities and type of training applied for, accompanied by the following documentation:
1. Report on the courses taken on the basis of the approval for which the extension is requested.
2. Certification accrediting that they are up to date with their tax and Social Security obligations, unless they authorise the Social Marine Institute to obtain the corresponding information from the State Tax Administration Agency, the Regional Tax Authorities and the Social Security General Treasury.
3. Certificate of the quality system in place, issued by an external audit, stating that the provision of specific health training is included.
4. Declaration of compliance with the minimum conditions set out in Annex II of Order PJC/1424/2025 of 9 December, by ticking the corresponding box on the application form.
5. For those instructors who wish to remain on the teaching staff assigned to the centre, application in accordance with the established model (Annex IV of the Resolution).
Once the documentation has been examined and the provincial directorate of the corresponding Social Marine Institute has verified that the minimum material and teaching staff conditions required by Order PJC/1424/2025 of 9 December continue to be met, the Subdirectorate General for Maritime Social Action will submit the proposal for the extension of the approval to the Directorate of the Social Marine Institute.
Communication Beginning of the academic year
1. Stable modality courses.
Notification of the start and end dates, contents, programme, timetables and teachers must be made at least fifteen days before the start of the course, by submitting the form in annex VI of this resolution to the provincial directorate of reference.
2. Itinerant modality courses.
The application for authorisation to start each course shall be addressed to the provincial directorate of reference, no less than one month before each course is held, using Annex V, which shall contain information on the locality, characteristics of the classroom or classrooms where the course is to be held, the start and end dates of the course, as well as the distribution of the course on the dates of the course and the list of teachers.
A plan or sketch showing the dimensions of the classroom or classrooms in which the course will be held must also be provided.
The provincial directorate of reference shall verify that the classrooms comply with the provisions of Annex II of Order PJC/1424/2025 of 9 December, requesting from other provincial directorates, if necessary, the documentation and inspection reports on the classrooms and courses where the itinerant training is to be given.
In view of the documentation received and the classroom inspection report, the provincial management will issue the corresponding resolution authorising the course to be held.
If there is a change in the location of the classroom initially notified, sufficient notice must be given, and the authorisation will be suspended until its adaptation has been verified.
Under no circumstances may authorisation be requested to give courses simultaneously in different locations and/or with identical timing.
Course development.
The approved centres must provide the provincial directorates of the Social Marine Institute in whose territorial area they carry out their training activity with the information that, with regard to the delivery of the courses, is established in Article 8 of Order PJC/1424/2025 of 9 December.
Likewise, any change that is foreseen to take place in the material or human resources available to the centre, as well as in the timetable for the teaching or programming of the courses, must be communicated, in advance, to the provincial management of the corresponding Social Marine Institute. Where prior notification is not possible, it shall be notified within five working days of the date on which the change takes place.
Likewise, the definitive list of students who will participate in the course must be sent to the corresponding provincial directorate 24 hours before the start of the authorised course, in accordance with Annex VII of the resolution.
In the case of specific initial health training courses, it is necessary that the information includes the department (bridge, machinery or radio) where the trainee carries out their activity in order to issue the corresponding certificate. For multi-purpose vocational graduates, the department to be recorded is the bridge department.
Certificates.
The official educational centres and private centres approved by the Social Marine Institute will issue students who have passed the specific health training courses with a certificate of accreditation, in accordance with Annex I of the Resolution of 15 December, which may be presented at any provincial directorate of the Social Marine Institute for the purpose of issuing the corresponding Certificate of Specific Health Training in Annex IV of Order PJC/1424/2025 of 9 December, duly updated.
Human resources.
The courses must have at least the following during their delivery:
Lead trainer: Doctor, nurse or equivalent.
Support Instructor: Nurse, Health Emergency Technician or equivalent.
For the accreditation of teachers by the Social Marine Institute, the centres must provide the following documentation for each of them:
1.- Application in accordance with the model set out in Annex IV of the Resolution of 15 December.
2.- For the purposes of accrediting their identity, the Social Marine Institute will consult the teacher's identity details in the Ministry for Home Affairs' databases. If the teacher does not give their authorisation for their data to be consulted, this must be stated in the corresponding application, in which case they must submit the national identity card or foreigner's identification number.
3.- Corresponding academic degree.
4.- Accreditation of teaching ability by means of one of the following documents:
1. Diploma certifying the successful completion of a course in pedagogical techniques of at least 80 hours, issued by an entity other than the applicant.
2. Documentation accrediting having taught a minimum of 160 hours of teaching activity related to the subject to be taught.
3. Master's Degree in Teacher Training for Compulsory Secondary Education, Baccalaureate, Vocational Training and Language Teaching, Certificate of Pedagogical Aptitude or equivalent.
Once accredited, teachers shall maintain their authorisation to provide health-specific training courses until the date of validity of the private centre's accreditation.
The approved centre must notify the Social Marine Institute of any change in its teaching staff. In the event that the change concerns the inclusion of a new teacher, the aforementioned documentation must be attached.
