The parents or guardians of a minor or a person lacking legal capacity who dies as a direct result of the offence shall be entitled to reimbursement of funeral expenses (wake, transport, cremation or burial), up to a maximum of five monthly IPREM payments.

UNDER NO CIRCUMSTANCES MAY THE AMOUNT OF THE AID EXCEED THE AMOUNT OF COMPENSATION SET BY THE JUDGMENT.

Where the victim suffers damage to their mental health, the amount of compensation, in accordance with the amendment introduced by Organic Law 10/2022 of 6 September, shall cover the financial compensation for the damages suffered, and the following factors, at a minimum, must be assessed:

a) Physical and mental harm, including harm to dignity, pain, suffering and emotional distress.

b) The loss of opportunities, including opportunities for education, employment and social benefits.

c) Material harm and loss of income, including loss of profits.

d) Social harm, including exclusion from the family or community.

e) Therapeutic, social and sexual and reproductive health treatment freely chosen by the victim, up to the maximum amount determined by the relevant regulations.

f) Unpaid domestic and care work.

This assessment and its quantification in terms of the amount of the grant are pending regulatory development, and therefore, until this is carried out, aid will be processed in accordance with the previous wording of the regulation, consisting of the reimbursement of the costs of the therapeutic treatment freely chosen by the victim, up to a maximum of five monthly IPREM payments.

In the event of death, the amount payable is calculated by applying the established adjustment coefficients to the ceiling of 120 monthly IPREM payments, based on the income of the beneficiary or beneficiaries and the number of the deceased’s dependants. Where there are several beneficiaries, the amount of the aid shall be allocated in accordance with the following rules:

• If both the spouse and the children are present: the aid is divided into two equal parts, one going to the spouse and the other to the children, who will share it equally amongst themselves.
  
• If only children are present: the aid will be divided equally amongst them.
  
• If the deceased’s parents are the beneficiaries, the corresponding amount shall be divided equally amongst them. If only one parent is entitled to the aid, they will receive the full amount.

In the event that the person concerned is a victim of sex-based violence in accordance with Article 23 of Organic Law 1/2004 or a victim of sexual violence in accordance with Article 37 of Organic Law 10/2022, the amount of the aid calculated in accordance with the provisions of the preceding paragraphs shall be increased by 25%.

In the event of death, the benefit will be increased by 25% for beneficiaries who are minor children or, in the case of adult children, where court-ordered support measures have been established.

• Temporary disability

Where a person is unable to work for a period exceeding six months, they are entitled to receive a benefit equivalent to twice the daily Public Indicator of Multiple Effect Income (IPREM) for as long as they remain in that situation, after the first six months have elapsed, for a maximum period of 18 months, which may be extended to 30 months in certain circumstances.

• Disabling injuries

The amount payable is calculated by applying adjustment coefficients to maximum thresholds, based on the victim’s financial circumstances and the number of people financially dependent on them. The maximum limits, depending on the degree of disability, are as follows:

• Partial permanent disability or disability of between 33 and 44%: 40 monthly IPREM payments.
  
• Total permanent disability or disability of between 45 and 64%: 60 monthly IPREM payments.
  
• Absolute permanent disability or a disability of more than 65%: 90 monthly IPREM payments.
  
• Severe disability or a disability of more than 75% requiring assistance from a third party: 130 monthly IPREM payments.
  

In 2025, the monthly IPREM figure is:
