In relation to sexual offences and sex-based violence
Where the victim suffers damage to their mental health, the amount of compensation, in accordance with the amendment introduced by Organic Law 10/2022 of 6 September, shall cover the financial compensation for the damages suffered, and the following factors, at a minimum, must be assessed:
a) Physical and mental harm, including harm to dignity, pain, suffering and emotional distress.
b) The loss of opportunities, including opportunities for education, employment and social benefits.
c) Material harm and loss of income, including loss of profits.
d) Social harm, including exclusion from the family or community.
e) Therapeutic, social and sexual and reproductive health treatment freely chosen by the victim, up to the maximum amount determined by the relevant regulations.
f) Unpaid domestic and care work.
This assessment and its quantification in terms of the amount of the grant are pending regulatory development, and therefore, until this is carried out, aid will be processed in accordance with the previous wording of the regulation, consisting of the reimbursement of the costs of the therapeutic treatment freely chosen by the victim, up to a maximum of five monthly IPREM payments.
Due to serious injury or harm to health
- Temporary disability
Where a person is unable to work for a period exceeding six months, they are entitled to receive a benefit equivalent to twice the daily Public Indicator of Multiple Effect Income (IPREM) for as long as they remain in that situation, after the first six months have elapsed, for a maximum period of 18 months, which may be extended to 30 months in certain circumstances.
- Disabling injuries
The amount payable is calculated by applying adjustment coefficients to maximum thresholds, based on the victim’s financial circumstances and the number of people financially dependent on them. The maximum limits, depending on the degree of disability, are as follows:
- Partial permanent disability or disability of between 33 and 44%: 40 monthly IPREM payments.
- Total permanent disability or disability of between 45 and 64%: 60 monthly IPREM payments.
- Absolute permanent disability or a disability of more than 65%: 90 monthly IPREM payments.
- Severe disability or a disability of more than 75% requiring assistance from a third party: 130 monthly IPREM payments.
In 2025, the monthly IPREM figure is:
