Affiliation, termination of affiliation, and data changes in the Special Scheme for Self-Employed Workers

Procedure for Affiliation, Cessation and Data Variation in the Special Self-employment Scheme

Purpose:

Affiliation, terminations to affiliation and changes to details must be reported to Social Security to let them know when an employee begins working, when they cease to work and when there are any changes to the personal and employment details of workers affiliated to Social Security.

Subjects:

The self-employed worker is directly responsible for complying with the obligation to apply for their registration, deregistration, and data changes.
If the worker does not comply with their, the Social Security General Treasury may act automatically.

Where to process it:

From 1 October 2018, it will be compulsory for self-employed workers to carry out their procedures with the Social Security online through the Services available in the e-Office or by means of an authorised person through the RED System".

Deadlines:

Applications for Registration:

  • Up to 60 calendar days prior to the beginning of the activity

Application for Deregistration and data changes:

  •  3 calendar days.
Effective:

Registrations:

  • Up to three registrations within each calendar year shall take effect from the day on which all the conditions are met, provided that they have been applied for within the statutory period.
  • The rest of the registrations that, as the case may be, occur within each calendar year shall take effect from the first day of the calendar month in which all the conditions are met, provided that the application has been made within the regulatory period.
  • Registrations requested outside the regulatory period shall also take effect from the first day of the calendar month in which the requirements for inclusion in this Special Scheme are met.

Deregistrations:

  • Up to three deregistrations within each calendar year shall take effect from the day on which the worker ceased the activity for which they were included, provided that they were requested within the statutory period.
  • The rest of the deregistrations that, where applicable, occur within each calendar year shall take effect from the first day of the month following that in which the worker ceased the activity that led to their inclusion, as requested within the regulatory period.
  • Should the worker not request termination to their affiliation or request it in a manner and period other than the ones specified for this purpose, or should said termination to affiliation be performed automatically, the affiliation thus maintained shall be effective regarding the obligation to make contributions and the worker shall not be deemed in active contributor status regarding the right to benefits.

Other important information: Coverage of the economic benefit for temporary disability shall be mandatory as of 1 January 2008, as established in Law 20/2007 of 11 July, the Self-employed Workers' Statute, except for:
  • Self-employed workers entitled to temporary disability benefit in another Social Security System scheme in which they are also registered while they maintain their pluri-activity.
  • Workers included in the Special System for Self-Employed Agricultural workers.

Likewise, as of 1 January 2019, coverage for work-related injuries and occupational diseases will be compulsory, as well as coverage for protection in the event of termination of activity and vocational training.
