Civilians with disabilities

DECREE 670/1976

Disability Pension: this is calculated by applying the percentage corresponding to the recognised degree of disability to a regulatory base, which is set annually in the General State Budget Acts.
In 2025, the base rate amounts to €7,596.76 on an annual basis (12 monthly instalments) or €633.06 on a monthly basis, resulting in the following amounts for disability pensions, depending on the recognised degree of disability:

LEY 6/1982

Originators:

• Disability pension: this shall be as set out in Decree 670/1976 and corresponds to the amounts shown in the table above
  
• Basic Remuneration: since 1-1-1991, beneficiaries have been entitled to 100 per cent of the basic remuneration, which is set annually in the General State Budget Acts and which, for 2025, amounts to €11,970.17 on an annual basis (12 monthly instalments) or €997.51 on a monthly basis.
  

In favour of family members:

Since 1-1-1996, the General State Budget Acts have set the amount of these pensions at the same level as the minimum Social Security widows’ pension for recipients aged over 65, which for 2025 is set at €874.40 per month.

• From Decree 670/1976: only the originators.
  
• Under Act 6/1982: the originators themselves and their widowed spouses, former spouses or civil partners and, failing that, orphans under the age of 21, or those over that age who have been unable to work at all since before reaching that age or since the death of the originator, provided they meet the requirements laid down in the civil service pension legislation applicable in each case.
  

Spanish nationals of any sex and age who meet the following criteria:

• Having suffered sustained injuries as a direct or indirect result of hostilities that took place on national territory between 18 July 1936 and 1 April 1939.
  
• Suffering, as a result of such injuries, a reduction in their physical or mental faculties of at least 26 per cent – in accordance with the injury assessment table set out in Decree 670/1976 of 5 March.
  
• Not being a member of the Distinguished Corps of Veterans in the War for the Fatherland.
  

To be entitled to the rights set out in Law 6/1982 – basic remuneration and pensions for family members ­– the injuries sustained by those maimed and are covered by Decree 670/1976 must result in a degree of disability of at least 45 points – in accordance with the table of injuries and illnesses currently in force for the purposes of Law 35/1980 of 26 June.
