Permanent Non-disabling Lesions benefit procedure

What is the Social Security non-disabling permanent injury benefit?

It is a lump-sum compensation to which workers are entitled due to injuries, mutilations and deformities of a permanent nature caused by a work-related injury and occupational disease which, although not constituting permanent disability, lead to a reduction or alteration in the physical integrity of the worker provided they are included in the classification established for that purpose.

When does it start and what procedures must be carried out?

  • Ex officio:
    • On the initiative of the managing body.
    • At the request of the Labour Inspection Authority.
    • At the request of the Public Health Service.
  • At the request of the collaborating entities.
  • At the request of the interested party:
    • Fill in the application form for permanent disability and non-disabling injuries.
    • The personal and specific documentation indicated in the application form.
      You can carry out this procedure through the Social Security e-Office (https://sede.seg-social.gob.es) by ordinary post or at a Social Security Attention and Information Centre, requesting an appointment by calling 901 10 65 70/ 91 541 25 30 or at the website www.seg-social.es or at the provincial or local offices of the Social Marine Institute (ISM).

The Disability Assessment Team (DAT) will issue the decision-proposal regarding the reduction or alteration of the worker's physical integrity due to the lesions. 

The provincial directors of the ISSN or ISM, as applicable, will issue an express decision indicating the injuries and the amount of the compensation.

When does the right to receive the benefit expire?

The annual expiry date is the day after the interested party is notified of the concession. When the administrative decision has been appealed in judicial proceedings, the calculation shall be made from the date of the judicial decision.
