Coming into force

  • European Community (EC) Regulations 883/04 and 987/09 are applicable to the coordination of the Social Security Systems of the member States of the European Union as of 01/05/2010.
    • Countries in the European Union: Germany, Austria, Belgium, Bulgaria, Czech Republic, Cyprus, Croatia (since 01-07-2013), Denmark, Slovakia, Slovenia, Spain, Estonia, Finland, France, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, the Netherlands, Poland, Portugal, United Kingdom, Romania and Sweden.  

(*TheUnited Kingdom left the European Union on 1 February 2020).

  • These Regulations are likewise applicable to relations with Switzerland as of 01/04/2012, and relations with the Countries in the European Economic Area, as of 01/06/2012.
    • Countries in the European Economic Area: Iceland, Liechtenstein and Norway.
  • Asof 01.01.2021 Community Regulations (EC) No 883/04 and No 987/09 continue to apply in Member States' relations with the United Kingdom under the Agreement on the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community of 31 January 2020 to  those persons who, on 31 December 2020, were in an EU-UK cross-border situation; in particular:
    • EU nationals who at that date were subject to UK law, or were resident or working in the UK at that date, and their family members.
    • To nationals of the United Kingdom who on that date were subject to the legislation of one or more Member States, or were resident or employed in the territory of one of them, and to members of their families.
    • Third-country nationals, refugees and stateless persons who were in one of the above situations on 31 December 2020.

The above-mentioned Regulations also apply where the persons concerned, although not falling under any of the above cases, have completed periods of insurance in the other party before 31 December 2020.

  • For situations arising from 1 January 2021 between one or more EU Member States and the United Kingdom, the Protocol on social security coordination of the Agreement on Trade and Cooperation between the European Union and the European Atomic Energy Community, of the one part, and the United Kingdom of Great Britain and Northern Ireland, of the other part, pending ratification by the European Parliament, shall provisionally apply.
