Benefits included in the Agreement

General information

The Agreement applies to the following benefits:

Relating to Spain:

To the following contributory benefits in the Social Security System:

  • Economic benefits for maternity
  • Benefits for disability, old age, and death and survival.
  • Financial benefits arising from work-related injuries and occupational diseases.
In relation to Argentina:

To the legislation regarding these contributory benefits from the Social Security System:

  • The Family Allowances scheme, solely for the Maternity Allowance.
  • The Retirement and Pensions schemes based on the Distribution System or on individual Capitalisation
  • The Risks at Work scheme.
Regarding these benefits, remember that:
  • To get the contributory benefits included in the Agreement, periods of insurance fulfilled in Spain and Argentina can be added together, if they do not overlap.
  • Contributory economic benefits can be collected regardless of whether the interested party is resident or currently located in Spain or Argentina.
  • Each country will pay its own benefits directly to the beneficiary.
  • Those who meet the requirements of the legislations of both countries for entitlement to a contributory pension may receive it from either country.

Maternity

For the granting of these benefits, the accredited periods of insurance in both countries will be added together, if necessary.

Disability, Old Age, and Survival

1. Spanish Social Security pensions, and retirement and pensions from the Argentinian distribution system. Each country will examine each application for benefits separately in the following way:

  • They will check that the interested party is entitled to the benefit, taking into account only their own periods of insurance, not those of the other country.
  • Also, they will calculate the benefit by adding together their own periods of insurance and those of the other country. In this case, the benefit will not be for the whole amount but a proportion of the periods of insurance in the country granting it and the sum of the periods for Spain and Argentina.
  • The benefits calculated as indicated in previous sections will be compared, and each country will recognise and pay the benefit which most favours the interested party.
  • In the case of a Spanish Social Security retirement pension that considers a total of insurance periods accredited in Argentina, this total shall also be used to determine the age of entitlement to the pension.

2. Retirement and pensions from the Argentinian individual capitalisation system:

  • Those affiliated to a Retirement and Pension Fund Administration are entitled to benefits taken out of the accumulated balance of their individual capitalisation account.
  • These benefits will be added to the benefits from the Argentinian Public Welfare or Distribution Schemes, if they meet the requirements set forth in Argentinian legislation.

Work-related Injury and Occupational Disease

The benefit will be determined by the country whose legislation the worker is subject to on the date when the accident occurred or the disease was contracted.
