The day of death provided that it occurs after 3 March 2019, the date of entry into force of Law 3/2019, of 1 March.

• The day after the death, if the application is presented within 3 months of this day.
• Maximum retroactivity of 3 months, from the date in which the application is presented.

However, it may be recognised even if the causal event occurred earlier than 3 March 2019, if they had then met the requirements that conditioned access to this benefit and on the date of the application, those on which the preservation of the right depends were to be maintained.
