Compatibility / Incompatibility / Termination

Compatibility

The partial retirement pension is compatible with:

  • Part-time work at the company and, when relevant, other part-time jobs prior to the partial retirement situation, whenever this does not increase the duration of the working day. If the working day is extended, the partial retirement pension is suspended.
  • Part-time jobs arranged following the partial retirement situation, when the employee stops working in the jobs previously carried out in other companies, whenever the working day in effect up to that date is not increased. If the working day is extended, the partial retirement pension is suspended.
  • The widowhood pension, the unemployment benefit and other benefits substituting the income earned from part-time jobs arranged prior to the partial retirement situation, under the terms indicated in the paragraph above, with the exception of the following section.

Incompatibilities

The partial retirement pension will be incompatible with:

Termination of benefits

Partial retirement pensions shall be terminated due to:

  • Death of the pensioner.
  • Granting of ordinary or early retirement in any of the legally recognised forms.
  • Granting of a permanent disablement pension declared incompatible.
  • Termination of the part-time contract made by the partially-retired pensioner, except when the pensioner has the right to unemployment benefits, compatible with partial retirement, or to other benefits substituting the income received, in which case the termination of the partial retirement  occurs on the date when these benefits are terminated.
  • The paragraph above does not applicable to unfair contract termination, in which case the partial retirement right is maintained in accordance with the obligations legally established for the company.
