Procedure for requesting the special agreement for Spanish emigrants and their children who have returned

General Information


Purpose:

The purpose of this Special Agreement is to cover the contribution bases corresponding to the contingencies of retirement, permanent disability, and death and survival.

Beneficiaries:

Spanish emigrants and their children who have Spanish nationality, whatever the country where they work, at the time when they return to Spanish territory, provided that they are not obligatorily included within any public social protection scheme in Spain.

Documentation:

Original and copy of the identification document:

  • National Identity Document, Foreign Citizen Card or Passport, as applicable.
  • Certificate issued by the Government Delegation or Sub-Delegation in the province where the applicant resides.
Where to process it:

At the Provincial or Administrative Offices of the Social Security Treasury General corresponding to the domicile of the applicant. If you have a digital certificate you can access the e-Office and submit the application form and required documentation online through the Special Agreement Registration process in the Social Security e-Office.

Deadlines:
  • At any time following the date of return, without there being a requirement to comply with any given time limit.
  • Family members, from the day following the date of death of the originator of the return, should s/he die abroad.
Effective:

It takes effect from the first day of the month following the date on which the application is presented.

Requirements:
  • Being an emigrant who has returned to Spain or an emigrant's child.
  • Having Spanish citizenship.
  • Not being obligatorily included within any public social protection scheme in Spain.
Termination:

Reasons for expiry:

  • Failure to make the payments corresponding to three consecutive or five alternative months.
  • When the interested party is included within the field of application of any Social Security Scheme.
  • Acquiring the status of pensioner due to retirement or permanent disability.
  • Decision by the interested party reported in writing to the Social Security Treasury General.
  • Due to the death of the interested party.
