Compulsory Elderly and Disability Insurance application procedure

General Information


Purpose:

To recognise lifetime and fixed-rate old age, disability or widow/widower's pensions for the contributions made to the now expired Old Age and Disability Insurance (SOVI) or having been affiliated with the Worker Retirement Scheme.

Beneficiaries:

The people who meet the established requirements for each type of pension.

Requirements:

In addition to not being entitled to a pension under the current Social Security system, with the exception of any widow/widower's pensions, certain specific requirements must be met depending on the type of pension in question:

  • Old age: Having reached the age of 65, or 60 in the case of old age with disability, and having made 1,800 days of contribution payments prior to 01/01/1967 or having been affiliated with the Worker Retirement Scheme.

  • Disability: 1,800 days contributed to SOVI, 50 years or over and permanently unfit for work.

  • Widow/Widower's Pension: The requirements depend on the date of death of the originator and on whether or not they were a pensioner.
Amount:

The amount varies depending on whether or not these overlap with other pensions:

  • If there is no overlap: 462.20 euros per month.
  • If there is an overlap:  448.60 euros per month.

When the widow/widower's pension and the SOVI pension overlap, the total amount may not exceed twice the amount of the minimum widow/widower's pension established at any given time for beneficiaries over the age of 65. If it exceeds this limit, the amount of the SOVI pension will be reduced by the amount required in order not to exceed the limit indicated.

Economic effects:

Old Age: This will accrue from the day after reaching the age of 65 if the application is submitted within the 30 days after this date.   If  it is submitted later, it will accrue from the first day of the month after the application was submitted.

Disability: This accrues from the first day of the month after the application was submitted.

Widows/Widower’s:

  • If the originator was not a pensioner and the application is submitted within one year of death, it will be paid from the first day of the month after the death. If it is submitted after one year from the date of death, it will be paid retroactively for one year from the application date.
  • If the originator was a pensioner and the application is submitted within 3 months of death, it will be paid from the first day of the month after the death. If it is submitted after the 3 months following the death, the retroactive payment will cover 3 months from the application.
Payment:

The pension is paid monthly with two extra payments that are paid with the June and November monthly payments.

Incompatibilities:

SOVI pensions are incompatible with each other and may also be incompatible with other pensions, with the exception of any widow/widower's pension to which the beneficiary may be entitled, and work. However, the beneficiaries may exercise their right to choose the most favourable pension.

Deadlines:

Acknowledgement of SOVI pensions must be resolved and the interested party must be notified within the following periods:

  • Old age and widow/widower's pension: 90 days.
  • Disability: 135 days.
Termination:

SOVI pensions expire with the pensioner's death and, in the case of the widow/widower's pension and in certain situations, with marriage or forming a common law partnership.

Forms:

Application for retirement, disability, or widowhood pensions.

Documentation:

The documents to be submitted to process the pension are listed on the application form for retirementdisability or widowhood.

Where it is processed:

In the Social Security help and information centres under the National Social Security Institute (INSS) or in the provincial or local offices of the Social Marine Institute (ISM), as applicable.

Competent body:

The INSS or ISM, as applicable, are responsible for managing and recognising the right to pensions from the now expired SOVI.
