Old Age

Requirements

  • To have reached 65 years of age or 60 in the case of old age due to disability. This disability must be permanent and total for the usual profession and not stem from a work-related injury or occupational disease.

  • Not having the right to any other pension charged to the schemes which make up the Social Security System or labour sectors pending integration into it, with the exception of widowhood pensions.

  • To have been affiliated to the Workers' Retirement Scheme or to have 1,800 days of contribution to the Compulsory Old Age and Disability Insurance covered before 01/01/67.

Content and amount

  • It consists of an imprescriptible fixed-amount, lifelong pension.
  • If it is not concurrent with other pensions, the amount will comprise the basic pension plus increases. As of 1-1-2024, this amount is 528.50 euros per month.

    The economic benefit recognised under Law 3/2005 of 18 March, and the pension received by those who were injured or disabled in the first degree due to the Spanish Civil War, whatever the regulatory legislation, and the allowance for third party assistance provided for in the revised text of the General Law on the Rights of Persons with Disabilities and their Social Inclusion, approved by Royal Legislative Decree 1/2013 of 29 November, and the extraordinary pensions derived from acts of terrorism, shall not be considered concurrent pensions.

  • If it is concurrent with other pensions, the amount will be 513 euros per month, effective 01-01-2024.

    However, when the sum of all concurrent pensions (after revaluation) plus the aforementioned SOVI pension, is less than the amount set for 2021 for the pension of said concurrent insurance, all calculated on an annual basis, the SOVI pension will be revalued by an amount equal to the resulting difference. This difference may not be consolidated, and it may be absorbed with any increase to the interested party´s earnings, whether through revaluation or the granting of new periodic benefits.

    If it is concurrent with a widow's/widower's pension, the sum of the widow's/widower's pension or pensions and the SOVI pension cannot be more than double the minimum widow's/widower's pension for beneficiaries aged 65 or over at any time, calculated annually. Should the aforementioned limit be exceeded, the SOVI pension will be reduced accordingly.

  • It is paid in 14 monthly payments.

 

Economic Conditions

  • The day following that on which 65 years of age are reached, if the application has been presented within 30 days immediately following that birthday.
  • From the first day of the month following the date of the application, when it has been presented within the stated deadline.
  • In the case of old age due to disability (at least 60 years), the right is made effective from the first day of the month following that on which the application is submitted.

Incompatibilities / Compatibilities

With the performance of any public or private activity:

Receiving the pension is incompatible with carrying out any public or private work or activity, as a employed or self-employed worker, which determines the pensioner´s inclusion in a Social Security scheme.

With other pensions of the Social Security System or outside of the system (except for widowhood pensions of which they may be beneficiaries):

  • Combining SOVI pensions:

    SOVI pensions are incompatible with each other. However, when an individual has the entitlement to more than one of these pensions, or while collecting one of them they acquire the right to another, the most favourable one may be collected.
  • Pensions recognised in accordance with the regulations for the General Scheme or Special Schemes:

    Are incompatible, except with the system's widowhood pension, although the beneficiaries may exercise their right to choose the most favourable pension.

    However, collecting a pension granted under the old work-related injuries regulations does not prevent the beneficiary from receiving any SOVI pension that they may be entitled to, whatever the nature or triggering event of the pension.
  • Pensions of workers from sectors that are pending inclusion provided for in the eighth temporary provision of the Revised Text of the General Social Security Act, approved by RDL  1/1994, of 20 June:

    Are incompatible whatever the nature or triggering event of the pension (except with widowhood pensions of these substitutory bodies which must be included in the Social Security system), although the beneficiaries may exercise the right to choose the most favourable pension.
  • Passive Classes pensions:

    SOVI pensions are incompatible with Passive Classes pensions with the same triggering event prior to 2.5.91, the date when RD  691/1991, of 12 April came into force, which sets out the reciprocal calculation of contributions between Social Security schemes.

    However, they are compatible when any of the pensions is triggered before the reciprocal calculation was set up or if the triggering event of the pensions is different, although, in this case the SOVI amount will be reduced since it overlaps another public pension that is not included in the System. 

    When the Passive Classes pension is a widowhood pension, the SOVI pension will be granted at the appropriate amount, considering the sum of both pensions may not be more than double the minimum amount of widowhood for beneficiaries over 65 years of ages, that is established at any given time. If it exceeds this limit, the amount of the SOVI pension will be reduced by the amount required not to exceed the specified limit.

With the economic benefits established by Law 3/2005, of 18 March:

SOVI pensions are compatible with special financial benefits, governed by Law 3/2005, which are granted to Spanish citizens relocated abroad during their childhood in the period between 18/07/1936 and 31/12/1939 as a result of the Spanish Civil War and who spent most of their life outside of Spain.

These benefits will under no circumstances be considered as concurrent benefits for the purposes of calculating the minimum amount of the SOVI pension (|Art. 4 Law 3/2005, of 18 March).

Applications and documentation

  • The applicant's National Identity Card.
  • The applicant's Tax Identity Card.
  • If the interested party is married: Family Book or marriage certificate.
  • National Identity Card of the spouse and family members under 14 years of age, who live with the applicant and are in his charge.
  • This documentation can be presented at any of the Attention and Information Centres of the Social Security.
