Economic allowance per child or minor fostered under charge

Purpose:

It is an economic allocation for each dependent child or foster child of the beneficiary under the age of 18, or older if affected by a degree of disability greater than or equal to 65%.

Originators:

The "dependent" children or foster children,  who live with and  depend economically on the beneficiary,  as long as they are under the age of 18, or older if affected by a degree of disability greater than or equal to 65%.

They are considered to be dependent, even if they have paid employment, as long as they continue living with the beneficiary and the income  from their work does not exceed 100% of the SMI in force at any given time, calculated on an annual basis.

Recipients:
  • The parents, adoptive parents or foster parents who fulfil the requirements.
  • Disabled children over the age of 18 who have not been legally disqualified and who retain the ability to work.
  • Orphans of both parents or adoptive parents under the age of 18 or with a degree of disability greater than or equal to 65%.
  • Children who are not orphans but have been abandoned by their parents or adoptive parents, as long as they are not in permanent or pre-adoptive foster care and they meet the age or disability requirements described in the previous point.

Requirements:
  • Legally residing in Spain.
  • To have dependent children or foster children under the age of 18, or older with a degree of disability greater than or equal to 65% and be resident in Spain.
  • To not be entitled to the same types of benefits in any other social protection scheme.
  • To not receive  an annual Income of any kind over the set limits. No income limit is required for acknowledging the status of beneficiary due to having a dependant child or foster child with disabilities.

Amounts /

Payments / Conditions:

The amount of the economic allocation differs according to the age and degree of disability of the dependent child or foster child.

Payment is made without any extra payments:

  • Every six months, in January and June, for children under the age of 18.
  • Monthly and in arrears for disabled adults over the age of 18.

The benefit is exempt from IRPF.

Starting on 1-1-2008 and at the beginning of each year, the benefit will be revaluated according to the CPI.

Duration:

The economic allocation that is initially acknowledged will be received, as long as changes do not occur in the family that cause the allocation to increase, decrease or terminate.

Periods:

The acknowledgement of the economic allocation should be resolved and notified within a maximum period of 45.

All beneficiaries have the obligation to submit, to the INSS within a period of 30 days, any changes in the family situation that involve the start, modification or end of the entitlement to receive the economic allocation.

Denial / Termination:
  • Death of the child.
  • The child reaches 18 years of age (except in cases of disability).
  • The disability ceases to exist.
  • The child is no longer economically dependent (when the child's income is over 100% of the  SMI).
  • The corresponding income limits are surpassed.

Documentation:

 The documents required to prove the identity and circumstances determining the entitlement.

In no case whatsoever will the applicant have to prove facts, data or circumstances that the Social Security Office should be aware of itself.

Where it is to be processed:

The application and necessary documentation should be submitted to any of the Social Security Support and Information Centres.

Competent entity:

Acknowledgement of the right to the benefit is the responsibility of the INSS.

In the event that one of the parents is included in a public Social Security scheme, the economic allocation will be acknowledged by this scheme.
