Declaration and Details of Family Variations
- All recipients are obliged to present the INSS, within 30 days counting from the date on which it occurred, a suitably certified document stating how many variations took place in their status that could mean that their right ot the benefit could change or end.
In no case is it necessary to prove with documents facts or circumstances, such as the amount of pensions or grants, that the the Social Security Administration can find out directly for itself.
- Prior to 1 April each year, the recipient must present a declaration of income earned during the previous fiscal year.
- Not complying with the previous sections when the changes that were not reported will lead to a reduction in or withdrawal of the benefit, are considered an infraction, as set out in section 2 of chapter III of the published text of the Law on infractions and sanctions in the social order, approved by R.D. Legislation 5/2000, of 4 August.
- If, as a result of the changes, the right is cancelled or reduced, the monthly allocations or positive differences paid, where appropriate, will be considered to be unlawfully received benefits from the day after the date when the economic effects of the change should have occurred.
In cases where the entitlement has been recognised and there are changes that result in an increase in the benefit, this increase will take effect on the first day of the calendar quarter immediately following the presentation of the request.
In cases where the changes cause either the entitlement to be cancelled or the amount of benefit paid to be decreased, this will not take effect until the last day of the calendar quarter in which the change took place.
In all cases, when the cancellation or modification is caused by a change in annual calculable income, the change will take effect on the 1 January of the year following the year in which the income was received.
In cases where cancellation is due to incompatibility with a non-contributory disability or retirement pension, the economic benefits will cease to be paid on the last day of the month in which the application for the pension was presented.
The economic allocations per dependent child or minor in foster care are calculated according to the monthly payments to which the beneficiary has a right during each fiscal year.
The payment of financial allocations for each dependent child will be:
Six-monthly and paid in arrears for minors aged under 18.
Monthly and paid in arrears, for disabled persons aged over 18.
