Early Retirement Based on Occupational Group or Activity


The normal retirement age may be lowered or brought forward for occupational groups or activities whose jobs are exceptionally arduous, dangerous, toxic or unhealthy and involve high mortality or morbidity rates, if the workers affected accredit in the respective profesion or work the minimum activity established, are on active contributor status or in an assimilated contributor situation and meet the other general requirements :

The application of the reduction coefficients will not entitle the interested party to access the retirement pension at an age below 52 years. This limitation will not affect workers in the Special Regimes (Coal Miners and Sea Workers) who, on 01-01-08, have recognised reduction coefficients for retirement age, to whom the previous regulations are applicable.

Since 01-01-08, the reduction coefficients will not be taken into account for the purpose of accrediting the age demanded to be entitled to partial retirement, early retirement when insured by a mutual society and any other form of early retirement, or  for the additional percentage for those retiring after the age of  65 years.

The law governing the general procedure for establishing retirement age must be followed. This foresees carrying out preliminary studies on accidents in the sector, arduous, toxic, dangerous or harmful working conditions, their impact on disability generated in workers and physical requirements demanded for carrying out the activity.

 



  • Employees under the age of 65 included in the scope of the Mining Statute (not included in the Special Scheme for Coal Mining) may be eligible for the retirement pension by applying the retirement age reduction coefficients, when arduous, toxic, dangerous or harmful conditions exist, under the terms and conditions established in the scale approved for that purpose.

  • The minimum age of 65 is reduced by a period equal to the result of applying the corresponding coefficient, in accordance with the scale set forth in the appendix to RD  2366/1984, of 26 December, to the period "actually worked" in each of the established categories or specialist areas, discounting all absences except for sick leave and authorised absences with pay.

  • The period of time by which the retirement age is reduced is considered as an effective period of contribution, only in determining the percentage applicable to the regulatory base.

  • Both the age reduction and the calculation of this period for the purposes of the percentage will apply, even when eligibility for the pension arises in any other Scheme than the General Scheme.

  • When the retirement affects workers who are "simultaneously" conducting other activities that lead to inclusion in any other Social Security scheme, such as multi-employment situations, the reduction is applied to age only.

UP



  • Technical flight crew members, included in the Employment Ordinance for airline personnel, may be eligible for the retirement pension prior to the age of 65 by applying the reduction coefficients to the retirement age.

  • The minimum age of 65 is reduced by a period equal to the result of applying the corresponding coefficient, in accordance with the scale set forth in RD  1559/1986, of 28 June, to the period "actually worked" in each category, discounting all absences except for sick leave and authorised absences with pay.

    • 0.40 for pilots and co-pilots.
    • 0.30 for the aircraft mechanics, aerial photography operations navigators, technological media operators, aerial photographers and aerial camera operators.

  • The period of time by which the retirement age is reduced is considered as an effective period of contribution, only in determining the percentage applicable to the regulatory base.

  • Both the age reduction and the calculation of this time period regarding the percentage will be applied, even when eligibility for the pension comes from a scheme other than the General Scheme.

  • When the retirement affects workers who are "simultaneously" conducting other activities that lead to inclusion in any other Social Security scheme, such as multi-employment situations, the reduction is applied to age only.

UP



  • The minimum age of 65 is reduced for railway workers who belong or have belonged to occupational groups and activities that are particularly dangerous or arduous for a period of time equal to the number of years resulting from the application of the corresponding coefficient (0.10 or 0.15), in accordance with the scale established in |art.  3 of RD  2621/1986, of 24 December, to the period of time "actually worked" in said groups and activities, discounting all absences except for those due to sick leave and absences with pay authorised by the applicable regulations.

  • The computable time period effectively worked for this purpose must be a whole number (without fractions) of years. If the calculation of this period results in a fraction of a year, those that exceed six months are calculated as a full year and those that are less are omitted.

  • Likewise, fractions of a year with different coefficients for dangerous activities are calculated as a full year in the activity in which the longest fraction of time is certified, if their sum exceeds six months.

  • The period between the early retirement age and the general minimum age is used to determine the applicable reduction coefficient, when appropriate, and is considered contributory only in relation to increasing the applicable pension percentage.

  • Both the age reduction and the calculation of this time period regarding the percentage will be applied, even when eligibility for the pension comes from a scheme other than the General Scheme.

  • When the retirement affects workers who are "simultaneously" conducting other activities that lead to inclusion in any other Social Security scheme, such as multi-employment situations, the reduction is applied to age only.

UP



  • Singers, dancers and trapeze artists may apply for the retirement pension at the age of 60, without applying reduction coefficients, when they have worked in the occupation for at least 8 years during the 21 years prior to retirement.

  • Other artists may retire at the age of 60, with an 8% reduction, to the percentage of the pension, for each year remaining to the age of 65.

  • In these two cases, it is mandatory to be on contributor status or in an assimilated contributor situation on the date of the right-granting event when applying for retirement.

UP



  • 55 years of age for matadors, mounted bullfighters, apprentice bullfighters, banderilleros, picadors and comedic bullfighters, provided that they are certified as being on active contributor status or in an assimilated contributor situation on the date of the right-granting event and that they have performed in a certain number of bullfights:

    • 150 fights for matadors, mounted bullfighters and apprentice bullfighters in any of these categories.
    • 200 fights for banderilleros, picadors and comedic bullfighters in any of these categories or in any of the categories indicated in the paragraph above.

  • 60 years for puntilleros, provided that they are certified as being on active contributor status or in an assimilated contributor situation on the date of the right-granting event and that they have participated in 250 fights in any professional category.

  • 65 years for bullfighting assistants and their aides.

    However, they may retire at the age of 60 with the application of an 8% reduction coefficient for each advance year, provided that they are certified as being on active contributor status or in an assimilated contributor situation on the date of the right-granting event and that they have performed in 250 fights in any professional category.

By virtue of RD 383/2008, dated 14 March, a retirement pension can be granted to workers under the age of 65 who work for another person or are self-employed and to public employees who are included in the General Social Security Scheme and serve as firemen, in the different ranks, categories or specialities, for local councils, autonomous communities, the Ministry of Defence, the Spanish Airports and Navigation Organisation (AENA) or for consortia or groups that could have been set up by the civil service departments listed.

The ordinary retirement age of 65, which is required to claim a retirement pension, is reduced by a period equivalent to the result of applying a reduction coefficient of 0.20 to the time actually worked as a fireman.
 
This reduction in the age of retirement will under no circumstances allow the interested party to claim a retirement pension when under the age of 60, or 59 if he or she has 35 or more years of effective contributions, without including the proportional part for the extra payments, while working as a fireman. 

To calculate the actual time worked, all days taken off will be discounted, except for the following:

  • Those which are due to having a medical certificate for a common or occupational illness or an accident, whether work-related or not.
  • Those which are due to suspension of the employment contract because of maternity, paternity, adoption, fostering, risk during pregnancy or risk during breastfeeding.
  • Those authorised in the corresponding labour resolutions as being entitled to remuneration.


The period of time by which the retirement age is reduced is considered to be contributory but only for the purpose of determining the percentage applicable to the regulating base.

Both the age reduction and the calculation of this time for purposes of the percentage are applicable, even if the pension is produced in a different Scheme from the General Scheme.


UP



  • The normal retirement age of 65, required to claim a retirement pension, will be reduced by a period equivalent to the result of applying the reduction coefficient of 0.20 to the number of full years actually worked as part of the Basque Police Force or as members of groups included in this organisation.

    The reduction in the age of retirement described in the previous paragraph will under no circumstances allow the interested party to claim a retirement pension when under the age of 60, or 59 if they can prove 35 or more years of effective work and contributions as part of the Basque Police Force or as members of groups included in this organisation, not counting the proportional amount of the extra payments made while carrying out the activity described in the previous paragraph.
  • The period of time by which the worker retirement age is reduced, in accordance with the foregoing paragraph, will be counted as an effective contribution period for the sole purpose of determining the percentage to be applied to the corresponding regulatory base to calculate the amount of the retirement pension.

    Both the age reduction and the calculation, for the purposes of contributions, of the time by which it is reduced, which are described in the foregoing paragraph, shall be applicable to members of the Basque Police Force who have had active contributor status up to the date of the triggering event of the retirement pension.

    Likewise, the entitlement to these benefits shall be maintained by those workers who, having reached the retirement eligibility age, as applicable, are eligible for the provisions of the first two paragraphs, and stop working as a member of the Basque Police Force but continue to have active contributor status as a result of carrying out a different job, irrespective of the Social Security scheme they are consequently part of.
  • An additional contribution rate, on top of the common contingencies base, shall be applied to this group, for both the employer and the worker. For 2010, this additional contribution rate will be 4%, with 3.34% payable by the employer and 0.66% payable by the worker. These contribution rates shall be adjusted over future years according to the group's assets and liabilities situation.

  • The system set out in the 47th Additional Provision of the LGSS shall be applicable after the Comisión Mixta de Cupo (Mixed Quota Commission) signs a financing agreement on behalf of the State for the annual amount corresponding to the additional contributions which have to be implemented as a result of the loss of contributions due to bringing forward the retirement age and the increase in benefits over the years in which retirement is brought forward, by an amount equivalent to that paid by the State Administration in the event of early retirement of members of the Spanish National Security Forces and Corps in the Passive Classes Scheme.
