Benefits for Risk during Breast Feeding

Purpose:

The economic benefit is intended to cover the loss of income that occurs, during a period of suspension of the work contract due to risk during breastfeeding, if the worker is required to change her job or activity for another that is compatible with her condition and this is technically or objectively impossible or cannot be required for justifiable reasons.

Recipients/Requirements:

Workers who are employed by others or self-employed under any Social Security Scheme, whose employment contract has been suspended or professional activity interrupted due to risk during breastfeeding and who fulfil the following requirements:

  • Are registered and affiliated.
  • Are up to date on their contribution payments, if responsible for paying contributions.

Contents/amount:

An award equivalent to 100% of the corresponding regulating base  which is the base for benefits given for TD  stemming from professional contingencies.

When making the payment, the amounts for Social Security contributions and IRPF withholdings will be deducted.

Duration/Termination:

The benefit will be paid during the time needed to protect the health of the worker and/or the child and will end:

Workers employed by others:

  • When the child reaches the age of 9 months.
  • Upon returning to the previous job or another job compatible with the situation.
  • Termination of the employment contract for legal reasons.
  • Due to stopping breastfeeding.
  • On death.

Self-Employed Workers:

  • When the child reaches the age of 9 months.
  • Upon returning to professional activity.
  • Termination in the Special Social Security Scheme.
  • On death.

Loss/suspension:

  • Fraudulent actions in obtaining or keeping the benefit.
  • Carrying out any work after the suspension of the activity that is incompatible with her condition.

Documentation:

The documents needed to prove identity and the circumstances that determine the right.

Where is it processed?

The application and documentation should be handed in at any of the Social Security Support and Information Centres of the Managing Body or, where appropriate, the Mutual Society for WRI  and OD  .

Competent entity:

The processing and payment of the benefit is the responsibility of the Provincial Directorate of the Managing Body (INSS or ISM), where the interested party resides, or the Mutual Society for WRI and OD, depending on the Managing Body that covers the occupational risks.

Periods:

The provincial Director of the management organisation in the province in which the interested party resides will make a direct decision and notify the interested party within 30 days.

The entitlement to the benefit expires 5 years from the day after the date of the triggering event, notwithstanding the fact that the effects came into force within the 3 months prior to the application date .
