Permanent Disability Procedure

What is the Social Security  Permanent Disability pension?

It is a benefit  that is granted to workers when, after having undergone the prescribed treatments and having been granted medical discharge, still present serious anatomical or functional reductions, which are considered to be permanent, which diminish or impair their ability to work.

When does this benefit start, and what are the steps that should be taken?

The procedure begins:

  • As routine procedure:
    • Upon the initiative of the Managing Body when the worker comes from Temporary Disability and has been granted medical discharge due to exceeding the allotted time, or being in a situation of permanent disability.
    • Upon the request Employment Inspectorate.
    • Upon the request of the Public Health Service, providing the medical discharge certificate and the medical history, following authorisation by the interested party.
  • Upon the request of the collaborating bodies, which will provide the medical discharge certificate, the medical history, and previous record of the worker.

  • Upon the request of the interested party:

    • Application form to request Permanent Disability, completed.
    • Personal documentation and the documents indicated on the application form.

    The application and documentation must be submitted at any of the Support and Information Centres of the National Institute of the Social Security.

    Workers to whom temporary disability is not applicable, either due to not being protected under this contingency or not being  affiliated, must submit the application to begin this procedure.

The Disability Assessment Team (EVI) will make the decision-proposal, taking into account the summarised medical report prepared by doctors from the Provincial Directorate of the INSS and the employment history report.


The Provincial Directorates of the INSS  will make an express decision stating the degree of disability, the amount of the financial benefit, and the date on which a disability review may be carried out due to conditions worsening or improving.


When does the right to the pension expire?

The pension may be terminated due to the Revision of Incapacity, due to the beginning of a Retirement pension, or if the pensioner dies.
