Benefits included in the Agreement

General Information:

The Agreement applies to the following benefits:

For Spain:

To the following benefits from the Spanish Social Security System:

    • Economic benefits for maternity.
    • Benefits for permanent disability, old age, death and survival.
    • Family protection benefits.
    • Financial benefits for work-related injuries and occupational illness.
For Uruguay:

They apply to the following Social Security benefits:

    • The scheme for maternity benefits.
    • The schemes for retirement and pensions based on the distribution or individual capitalisation systems.
    • The scheme for work-related injuries and occupational diseases.
For these benefits, you must be aware that:
    • To get the contributive benefits included in the Agreement, periods of insurance fulfilled in Spain and Uruguay can be added together.
    • Contributory economic benefits, except for those for temporary disability due to work-related injuries and occupational diseases, can be collected regardless of whether the interested party is resident or is currently in Spain or Uruguay.
    • Each country pays its own benefits directly to the recipient.
    • Those who meet the requirements of the legislation of both countries to be entitled to a contributive pension can collect it from both.

Maternity

It is granted by the country where the recipient is insured, taking into account, if necessary, any periods of insurance in the other country.

Disability, Old Age and Survival

1.- Spanish Social Security pensions and retirement and pensions based on the Uruguayan distribution system.

Each country will examine each application for benefits separately in the following way:

  • It will check that the interested party is entitled to the benefit, taking into account only its own periods of insurance, not those of the other country.
  • Also, it will calculate the benefit by adding together its own periods of insurance and those of the other country. In this case, the benefit will not be for the whole amount but a proportion of the periods of insurance in the country granting it and the sum of the periods for Spain and Uruguay.
  • The benefits calculated as shown in the previous sections will be compared and each country will recognise and pay the benefit that favours the interested party.
2.- Retirement and pensions from the Uruguayan individual capitalisation system:
  • Workers affiliated to a Pension Savings Fund Administration will be entitled to pensions based on the accumulated balance in their individual capitalisation accounts.
  • These benefits will be added to the benefits from the Uruguayan distributions scheme, if the worker meets the requirements of the Uruguayan legislation.

Work-related Injuries and Occupational Diseases:

The benefit will be determined by the country whose legislation the worker is subject to on the date when the accident occurred or the disease was contracted.
