Special Agreement for non-professional carers of dependent people, R.D. 615/2007

Protective Action

The protective action provided by this Special Agreement will be that corresponding to retirement and  permanent disability and death and survival, arising from injuries or diseases, irrespective of their nature.

Application filing and deadline

Applications should be handed in at the Provincial Office of the General Treasury of the Social Security or the Administrative office listed in the form (form TA-0040).

Effects

The effects will come into force on the date of application for the special agreement. 

Reasons for expiration

The agreement for this group expires for any of the following reasons:

  • If the carer becomes entitled to a retirement, permanent disability, widow's or family member's pension or reaches the age of 65 in any of the Social Security Schemes.
  • If the person cared for dies or the economic benefit for family care collected this person expires, or if the carer dies.
  • If the carer stops providing the care.
  • If the carer no longer meets the requirements set forth in RD  615/2007.

Other

Contributions to the Social Security under this special agreement will be charged exclusively to the signatory.

For areas that are not mentioned in the regulations for this special agreement, the agreement is regulated by Chapter 1 of Order TAS/2865/2003 of 13 October.

Who can receive it?

Non-professional carers of dependent people who receive the economic benefit regulated by RD 615/2007 of 11 May (Official State Gazette-BOE of the 12th).

New regulation: Article 4.12 and 13 of Royal Decree-Law 6/2019 of 1 March 2019 and final provision two point three of Royal Decree-Law 8/2019 of 8 March.

Generally, to be eligible, it is necessary for the carer not to be affiliated to any Social Security Scheme, for full time work or unemployment or to receive certain benefits.

IMPORTANT:

In accordance with the new regulations, as of 1 April 2019, the contribution corresponding to the special agreements in the Social Security System for non-professional carers of dependent persons provided for in Royal Decree 615/2007, of 11 May, regulating the Social Security of carers of dependent persons, will be paid by the General State Administration. Likewise, agreements existing on this date, 1 April 2019, will be understood to subsist, with the contribution to be paid also being paid by the General State Administration.
