Special agreement for Spanish emigrants and their children working abroad, and for lay persons, missionaries, and aid workers

Procedimiento

General Information


Purpose:

To cover the contribution bases corresponding to the contingencies of retirement, permanent disability, and death and survival.

Beneficiaries:

Spanish emigrants and their children who have Spanish nationality, regardless of whether or not they have been previously affiliated to the Spanish Social Security system, and regardless of the country where they work and whether or not that country has signed a Social Security agreement or treaty with Spain.

Lay persons, missionaries, and aid workers dependent on the Episcopal Conference, Dioceses, Orders, Congregations, and other religious Institutions, as well as non-governmental organisations, who have Spanish nationality and are sent to foreign countries by their respective organisations or institutions without having a labour relationship with them.

Spanish citizens taking part in training or research programmes abroad and receive remuneration without previously being affiliates of the Social Security system, regardless of the concept or the form of remuneration they receive, without being obligated by an employment relationship will be considered emigrants for the sole purpose of subscribing to this type of special agreement. Documentation:

Original and copy:

  • Of the National Identification Document, Foreign Citizen Card or Passport.
  • Work or residence permits issued by the respective authorities of the registration country, and certified by the Department of Employment and Social Security or by the Spanish Consulate in that country or a document of accreditation.
  • Work certificate issued by the company -certified and translated by the embassy.
  • Certificate of residency issued by the embassy.
Where to process it:

At the Provincial Offices of the Social Security Treasury General of Madrid . If you have a digital certificate you can access the e-Office and submit the application form and required documentation online through the Special Agreement Registration process in the Social Security e-Office.

Deadlines:

No time limit is set for filing the application; it may be filed at any time.

Effective:

It takes effect from the first day of the month following the date on which the application is presented.

Having Spanish citizenship.

Termination:

Reasons for expiry:

  • Failure to make the payments corresponding to two consecutive quarters.
  • When the interested party is included within the field of application of any Social Security Scheme. 
  • Acquiring the status of pensioner due to retirement or permanent disability.
  • Decision by the interested party reported in writing to the Social Security Treasury General.
  • Due to the death of the interested party.
Other important information:
  • Payments shall be made at quarter's end within the month following the end of the calendar quarter. The applicable contribution basis is the minimum that, at any time, corresponds to workers over 18 years of age who are included in the General Scheme. The rate of contribution in effect in said Scheme shall be applied thereto, and the coefficient specified to this end shall be applied to the result, with the resulting amount being the payment due. 
  • This special agreement is regulated by article 15 of Order TAS/2865/2003, of 13 October, amended by Order TAS/819/2004 of 12 March (BOE of the 31st).
