Foreign students

Can a student who does not have prior authorisation to work or a foreign resident number be registered?

The registration of these students in the General Social Security Scheme may be processed pursuant to Additional Provision 52 LGSS as long as they reside and are legally in Spain, even if they do not have prior authorisation to work, as they are not workers but are assimilated to workers employed by another person.

Registration may be processed even if those who, on a temporary basis, do not have the NIE, although the application for the same must be accredited at the time of registration with the Social Security and the identity of the student must be proven by presenting the corresponding valid passport.

Can Erasmus+ students be registered even if they do not have a foreign resident number (NIE)?

In the event that such students are included in the field of application of DA 52 TRLGSS, registration may be processed even if they do not have a NIE, although the application for it must be accredited at the time of registration with the Social Security, as well as the student's identity by presenting the corresponding valid passport.

Are internships undertaken by non-EU students who do not have a work permit and whose visa is for study purposes included?

If these students move temporarily to Spain and enrol at a Spanish university or centre and, as a consequence of this enrolment, they undertake a work placement in Spain under the terms and conditions of Additional Provision 52, it is considered that these students would be included.

These non-EU trainees who do not have a work permit but do have a study visa may be registered with the general social security system, provided that they are legally residing in or present in Spain at the time of registration.


Would this include students who want to access the training paths by taking a certificate of professionalism with a non-work experience module, even if they do not have a NIE or residence permit?

Yes, provided that they have a residence permit at the time of registration.
