Those to whom the Regulations apply

  • People who are or have been subject to the legislation of one or more Member States, and are:
    • Nationals of an European Union Member State, country in the European Economic Area or  Switzerland, or
    • stateless persons and refugees who reside in one of the EU Member States, countries in the European Economic Area or  Switzerland.

They are also applicable to family members and the survivors of the foregoing.

They are also applicable to the survivors of persons who have been subject to the legislation of one or more Member States, irrespective of the nationality of said persons, if said survivors are nationals of one of the European Union Member States, country in the European Economic Area or Switzerland, or are stateless persons or refugees who reside in the territory of the European Union, the European Economic Area or Switzerland.

  • Nationals of third countries legally residing in an EU Member State (except Denmark and the United Kingdom), in accordance with EC Regulation No. 1231/2010, which extends the provisions of EC Regulation 883/04 to cover this group, with the following exceptions:
    • Relations with Denmark (in other words, if the interested party is or has been subject to both Danish legislation and the legislation of one or more other Member States). In Denmark the Social Security Community Regulations are not applicable to nationals of third countries.
    • Relations with the United Kingdom. In this Member State, EEC Regulations 1408/71 and 574/72 are still applicable to nationals of third countries.
