Social Security

Affiliation, termination of affiliation, and data changes are compulsory notifications which must be made to the Social Security in order to report the beginning or end of a worker's labour activity or a change in the personal information and labour data of workers affiliated to the Social Security.

The employer is obliged to apply for affiliation and termination of affiliation and to report changes of information for all his/her workers.

• Affiliation and Data changes:     Form TA2/S.
• Termination of affiliation:  Forms TA2/S  and  TA2/S-Simplified .

• At the Provincial Office of the General Treasury of the Social Security or an Administrative office.
• Through the RED System.

Applications for affiliation:

• Up to 60 days before the start of the employment relationship.
  
  In those cases in which the start date cannot be predicted in advance, if the day or days prior to starting are non-working days, or likewise if the provision of services begins during non-working hours, they must be submitted prior to the beginning of the provision of services, by telegram, fax, or any other electronic, computer or telematic means.

Applications for Termination of Affiliation:

• 6 calendar days from termination of the labour activity.

Data changes:

• 6 calendar days.

Affiliation:

• Affiliations submitted prior to the beginning of activity are effective from the day the activity begins.
• Affiliations submitted outside the time limit are effective from the day on which the application is filed, unless payments have been made within the regulation period, in which case affiliation is retroactively effective from the date on which the first payments corresponding to the worker were made.
• Affiliations performed automatically are retroactively effective from the date on which the facts motivating them are known.

Termination of affiliation:

• The worker's termination of affiliation is effective from the end of providing services.
• The worker application for termination of affiliation will end the obligation to make contributions as from the date work ceases. 
• If termination of affiliation is applied for outside the time limit, the obligation to make contributions expires on the day on which the General Treasury of the Social Security becomes aware that the activity has ended.
• When the General Treasury of the Social Security makes an automatic termination of affiliation, the obligation to make contributions expires on the day the inspection took place, or the data or documents providing proof that the work ended have been received.

Employers are obliged to apply for affiliation and termination of affiliation and to report changes of information for all their workers. Should they do not do so, the worker can do it directly at the Treasury General of the Social Security.
Affiliations, terminations of affiliation or data changes can be done by the Provincial directorate of the Treasury General of the Social Security or the Administrative Office in the province if neither the employer nor the worker has reported them.
