Special agreement for situations in which a worker remains registered with the social security but receives no wages, fulfilling public obligations, permits and licenses

Who may apply?

Workers may subscribe to this special agreement when on active contributor status without wages, fulfilling public obligations, permissions or licenses, which do not allow for leave, in which, in accordance with article 69 of the General Regulations for Contribution and Settlement of other Social Security Rights, approved by Royal Decree 2064/1995, of 22 December, the contribution obligation remains, if the contribution basis for the natural month prior to the start date of those situations is greater than the minimum basis for the occupational classification corresponding to the worker.

Application Method and Deadline

The application (form TA-0040) must be submitted to the Provincial Department of the Social Security Treasury Office or its Administration office within 90 natural days of the originating date or at any time.

Protective Action

The purpose of the special agreement is to provide coverage for all eventualities covered by the scheme in which the worker is on active contributor status without compensation.

Requirements

On active contributor status without receiving contributions while fulfilling public obligations or on leave.

Effective dates

The presentation date of the application or the date of the situation determined by the special agreement when the application is submitted within 90 days following the date of the situation.

Causes for Termination

- Due to the interested party entering into the situation of retirement or permanent disability pensioner.

- Due to the interested party being included under the scope of any Social Security scheme.

- Due to failure to make three consecutive or five alternative monthly payments.

- Due to death of the interested party.

- Due to a decision by the interested party, duly notified to the Social Security Treasury Office..

Contribution

The contribution basis is the difference between the basis for the month prior to the beginning of the situations and the minimum of the contribution group in which the worker is on contribution status. The contribution basis cannot exceed the maximum contribution basis for the scheme, in all cases. The deadline for making the payment is the month following the one in which the payment is made.
