Incompatibilities / Compatibilities

Receipt of the pension is incompatible with carrying out employed or self-employed work, or with carrying out activities for any of the public administrations, which give rise to the inclusion in the General Scheme  or any of the Special Schemes, with the following exceptions:

  • People who "access" retirement may make the reception of the pension compatible with a part time job under the established conditions. During this situation, called partial retirement, the reception of the pension will be reduced in the inverse proportion to the reduction applicable to the pensioner's working day in relation to that of a comparable full time worker.
  • Retirement pensioners  can make  their resulting pension compatible with part time work under the terms established. During this situation, called  flexible retirement, the reception of the pension will be reduced in the inverse proportion to the reduction applicable to the pensioner's working day in relation to that of a comparable full time worker..

Those pensioners who, on 28-11-02, had suspended their pension due to incompatibility with the work carried out may resort to flexible retirement. The effects of the recovering the pension, in the corresponding amount, according to the working day carried out, can be backdated a maximum of 3 months from the date of application, although it is not possible prior to 28-11-02 under any circumstances.

  • Carrying out other work, which is not part time under the terms established,  produces the following effects:
    • The retirement pension is suspended, including health care inherent in the pensioner status.

    • The employer is obliged to request  active contributor status  and pay the  corresponding contributions.

    • The new contributions will be applied:

      • In the first place, if applicable, to increase  the ordinary percentage  of the regulating base (up to 100% with 35 years of contribution) and to lower the reduction coefficient of the pension.

      • Once the 100% limit has been reached and the reducer coefficient suppressed, the excess time period, calculated by complete years, will  accredit  the percentage by an additional 2% for each complete year contributed.

      • Under no circumstances may the new contributions modify the regulating base.
