Death and Survivors

Death and survivors' benefits are set up to compensate for the financial hardship of certain people, caused by the death of others.

Without prejudice to the first additional provision of Organic Law 1/2004 of 28 December on Comprehensive Protection Measures against Gender Violence, the status of beneficiary of death and survival benefits that would correspond to the party convicted of a final sentence for committing an intentional crime of murder in any form, cannot be claimed if the victim were to be the originator of the benefit. Final Provision 10.1 of the Law 26/2015 of 28 July on the modification of the system of protection for children and adolescents.

The Managing Body shall provisionally suspend the payment of death and survival benefits which apply when the judicial decision can reasonably be taken to mean that the investigated subject has committed murder in any form, if the victim was the originator of the benefit, with effect from the first day of the month following the communication of said fact. Final Provision 10.2 of Law 26/2015.  

These benefits are included under the protective action of the General Scheme and the Special Schemes of the Social Security System, with the particular conditions indicated for each case in the relevant Special Scheme. The SOVI widowhood pension can still be received alongside these schemes.
