Workers moving abroad

Workers moving abroad

As a general rule, workers who move abroad are subject to the Social Security legislation of the country where they are working. However, if this is a temporary transfer, they can remain under Spanish legislation in accordance with the terms and conditions set out below.

It applies to employees and self-employed workers from both countries, regardless of their nationality. 

Initial move

For workers employed by another person who work for a Spanish company and are sent by it to work temporarily in Argentina and for workers who are self-employed in Spain and temporarily move to Argentina to work, the corresponding transfer certificate should be applied for at a Provincial or Administrative Office of the General Treasury of the Social Security.

Application form

The company or worker must make the application on form TA.200   "Application to remain under Spanish Social Security legislation - Initial expatriations" together with form E-ARG F.1 "Certificate of temporary transfer" filled out in triplicate.

The form issued by the local Provincial or Administrative Office certifies that the worker continues to be subject to Spanish Social Security legislation during his or her stay in that country and therefore is exempt from Argentinian Social Security contributions.

Period of authorisation 

For both employees and self-employed workers, the maximum length of time for the expatriation is twenty-four months. 

Ordinary extension

If the expatriation or transfer must be extended beyond the aforementioned time period, the employer or self-employed worker should apply for an extension to the General Sub-Directorate for Affiliation and Special Procedures of the Treasury General of the Social Security, three months before the end of the twenty-four month period. This Body will request the competent Argentinian institution to extend the initial transfer, which must be duly justified.

Application form

The application for an extension must be made on form TA.202   "Application to remain under Spanish Social Security legislation in accordance with |art. 17 of EEC  Regulation 1408/71 and other extensions of Bilateral Agreements" together with form E-ARG F.2 "Extension of expatriation", filled out in four copies, to be sent to the other country.

This form is issued by the Argentinian Social Security to certify that the worker continues to be subject to Spanish Social Security legislation for the period of time authorised.

Period of authorisation  

No maximum length of time for the extension is specified in the Agreement.

Other transfers

The Provincial or Administrative Offices of the Social Security Treasury General.

Are the bodies with the power to authorise transfers for:

  • Itinerant personnel of air transport companies with their headquarters in Spain who work in the two countries.
Application form

The application must be submitted to the Provincial or Administrative Office of General Treasury of the Social Security, with form E-ARG F.1 "Certificate of temporary transfer", filled out in triplicate.

The company must also submit application form TA-201.

General Sub-Directorate for Affiliation and Special Procedures.

Is the body with the power to authorise transfers for:

  • Administrative and technical personal and service personnel of Diplomatic Missions and Consular Offices in Argentina who are public civil servants
  • Those sent on missions of cooperation.

The General Sub-Directorate for Affiliation and Special Procedures of the Treasury General shall issue the form E-ARG F.1 , "Certificate of temporary transfer", upon the request of the Public Body or worker.

For the transfer of:

  • Spanish citizens who are not public civil servants, but work in Spanish Diplomatic Missions or Consular Offices in Argentina.
  • Spanish personnel in the private service of representatives at these Missions or Offices

who opt for Spanish Social Security legislation, the General Sub-Directorate for Affiliation and Special Procedures will issue form E-ARG F.3 , "Exercising the right to choose", for the full duration of the expatriation, upon the request of the Public Body or worker, which will be submitted in triplicate copy.

Other exceptions

Applications for other exceptions are processed by the General Sub-Directorate for Affiliation and Special Procedures of the Treasury General of the Social Security.

The application for an extension must be made by the company or self-employed worker on form TA.202   "Application to remain under Spanish Social Security legislation under the terms of art.17 of EEC Regulation 1408/71 and other extensions of Bilateral Agreements".

Once the Argentinean Social Security system has given its consent, the General Sub-Directorate for Affiliation and Special Procedures of the Treasury General of the Social Security will issue form E-ARG F1, certifying that the worker continues to be subject to Spanish Social Security legislation for the authorised period.
