Special Agrarian Regime




Workers over sixteen years of age who work as a person employed by another person and carry out agricultural labour of a paid nature within the area of organisation and direction of another physical or juridical person.

Expressly excluded are:

Shepherds, Rural Guards and Game or Fishing Reserve Guards who are responsible for the custody of animals or vigilance in agrarian establishments of one or several owners.

Workers employed in irrigation work and cleaning and dredging irrigation channels, when this work has no other purpose than the use of the water for the exclusive use of agricultural and livestock breeding establishments.

Workers who, as auxiliary elements, render services that are not truly agricultural, forest or livestock breeding activities, in a habitual manner with a permanent remuneration on agricultural establishments. Technicians, administrative staff, mechanics, vehicle and machinery drivers and any other professionals who carry out their work on the establishment will have this character.

Exclusions:

Those mechanics and drivers of vehicles and machinery whose owners rent out their services for agricultural and livestock breeding work, without being the owners of an establishment or when, even if they are owners, do not use these in their establishment.

Operators who work directly for Companies whose activity is the application of pesticides.

The spouse, children, parents and other family members of the employers by blood or affinity up to and including the third degree, employed on the agricultural establishment of the employers when they live together in the employer's home and are in the employer's charge, unless their condition of salary earners is proven, without prejudice to having the consideration of self-employed workers.
