Failure to fulfil the obligations described in the following paragraphs will constitute a violation in accordance with the provisions of Section 2, Chapter III of the Law on Infractions and Sanctions in the Social Order, approved by RLD 5/2000, of 4 August (BOE 189 of 8 August).

 



The following variations must be notified within 30 days of their occurrence:

  • Change of address: Usual or tax residence.

  • Beginning of work.

  • Change in economic situation: work income, awarding and/or receipt of other benefits or pensions, either national or foreign, or any other type of income.

  • Change in family situation: marital status, births, deaths...

  • Likewise, recipients of Social Security financial benefits, whose enjoyment is conditional on effective residency in Spain may be summoned to appear at the offices of the competent Managing Body.

    If the documentation required is not submitted within the deadline established or the beneficiary does not appear before the Management Body when summoned, the benefit or complements to minimums will be suspended as a precautionary measure. If the documentation requested is submitted or the beneficiary attends the office when more than 90 days have elapsed since the request or summons, the benefit or its complement will be backdated for a maximum term of 90 days.

The pensioners receiving minimum supplements who, in the previous year, have received income from emploment and/or capital gains or any other sources (not including the pension to be supplemented), in excess of the amount annually set in the LPGE, must submit a declaration stating this circumstance before 1 March each year.

Without prejudice to the requirement set forth in the foregoing paragraph, in order to prove earnings or income the Social Security Managing Bodies can at any given time request a declaration, from the receipients of minimum supplements, of this income, as well as their property assets and, where applicable, that they provide their submitted tax statements.

They are required to declare, within one month of it occuring, any variation to their marital status that affects this situation, as well as any change in the financial dependency status of their spouse.

Without affecting the above, the management entity may request the spouses identification, as well as the declaration of the income received by both partners, at any time.

Given that the requirements (lack of income, family dependants and that the widowhood pension represents the primary source of income) must all be met simultaneously, pensioners are required to submit, within 30 days of the date on which they occur, a duly certified notification of any variations to their family or financial circumstances that may lead to the accrual or termination of the right to said percentage of the pension.

For the purpose of establishing the family dependants, pensioners must submit, prior to 1 March each year, a declaration of income for the previous year of the pensioner and the members of the family unit.

For the purpose of establishing the family dependants, pensioners must submit, prior to 1 March each year, a declaration of income for the previous year of the pensioner and the members of the family unit.
