Procedure for Maternity

What are maternity benefits?

The benefits consist of a subsidy granted to all workers who enjoy legally established work leave periods in cases of biological maternity, adoption and foster care. 

It starts from the date of birth or from the start of leave, if this is prior to the birth, or from the date of the legal ruling granting adoption, or from the administrative decision or legal ruling granting foster care.

What procedures must be followed?

The Public Health Service doctor must deliver the maternity report to the mother.

The official form, “Application for Maternity, Adoption or Foster Care” must be filled in, or any other form which, although not official, contains the same information.

The mother must submit the original maternity report to the company, which must return it duly filled in.

In addition to the maternity report, the mother will need her personal documentation and the specific documents depending on whether it is a natural birth, adoption or foster care.

Where is it processed?

The mother must submit the application, the filled in maternity report and the documentation to the competent managing body of the INSS  or ISM , or any official registry.

Who grants and pays the benefit?

The competent managing body (INSS or ISM).

When do benefits end?

When the legally established weeks of leave have elapsed.
